Need info in transferring to another company

Hi everyone, I'm in Jeddah now and I work as a safety coordinator in a construction company for 8 months now but my company delayed my salary for 3 months. That is why I wanted to join to another company with better management and benefits. What would be the procedure for this?

Start looking for other construction companies first , if you manage to get a contract , then quit and join the other company .

Yes i already have a company to hire me. But u have any advice what should i do if my present company would not release me?

If you resign i don't think they have the right not to release you.Why would they keep you if stop working there.

I had a doubt that my company would not give an NOC if I decide to leave them. Because this never happend before in our company.

it depends actually, what's the details of your contract? if it specify a certain years then they can really hold you, the only thing you can do is talk to the H.R. dept and ask what's causing the delay of the salary, i believe the only way out of this is either filing a formal complaint if you just want to stop the delay of salary release or as i said talk with your H.R. if you are really going for a resignation, but this might cause a little stir in your company,  and also they might not certify you if you didn't finish the contract you have signed, but for the release as long as you are cleared(possibly payed what's needed to be paid if they require you too) and you're not on the wrong foot with your HR team i think they can work something out to release you or let you resign.

according to my contract details, it says that the validity of my contract will be 2 years from the date of my departure from philippines. I am still 7months and 25 days here in my company. and yes our HR specialist is a friend of mine so basically he could help me out with this. anyway, what should be the employees rights that is should look on to the saudi labor law for non-saudi? and what would be the procedure just in-case my company would allow me to be released?

It actually depends, if you will based it on the LABOR LAW it's already a violation, i believe your contract specified that you are on either monthly compensation, so if you are really eager to resign you can refer to this law;
Article 81:
Without prejudice to all of his statutory rights, the workman may quit his job without notice in any of the following cases:
1. If the employer fails to fulfill his essential contractual or statutory obligations towards the workman.
well, the procedure will be they will either be forced to grant you a exit visa with full benefits and certificates or you can set the terms 4 urself(if they will be scared that you'll file a formal complaint to the LABOR), or you can proceed and file a complaint to the SAUDI LABOR GROUP and get justice if that's whats your aiming at; in short you guys have their necks of course with solid proofs and everything to back it up.
