Question on Mauritian inheritance law

Hi there,

Ok I have two Mauritian cousins(they are siblings)who have been residing abroad since 2005. They are still Mauritian nationals, both US green card holders. My question is, what sort of inheritor rights do they have to family property in Mauritius? Their father died a few years ago following which they and their mom inherited the family home. They just recently found out that their mom sold off the property (the house+the land) last year without informing them about it. Was she within her rights to do that?

If they have been abroad since 2005, I assume that they must knoe French and their droit patrimonial goes like this :
L’Île Maurice étant une colonie française en 1917, le Code Napoléon de 1804 s’applique tant au niveau des lois qu’au niveau des pratiques notariales.

La transmission patrimoniale se fait par l’ouverture de la succession au jour du décès du de cujus, par donation et par testament.

Les lois sur la donation et sur le testament sont importées de France.

Les enfants naturels et légitimes ont les mêmes droits.

Le conjoint survivant a la même part qu’un enfant dans la succession. Il a aussi un droit d’usufruit sur le logement principal du ménage

Did she leave a will?
If not do you know where or at which bank she had her money?
You can bring the affidavit and other papers that the bank will require before disbursing the money.
Why don't you check with the bank or the notary who did the will?
