Visa for newborn born in India - Single Permit A card holders

Hello everyone,


My wife and I both hold a Single Permit (A card) in Belgium. 

During my wife’s 8th month of pregnancy, we traveled to India and our baby was born there.


We will be applying for my baby’s visa in India next week. I’m not sure how long the visa process will take. 

I’m also concerned because my wife is not allowed to stay outside Belgium for more than 6 consecutive months, otherwise re-entry could be an issue.


Has anyone gone through a similar situation with a newborn born outside Belgium while on a Single Permit? 

Any insights or advice on the timeline and process would be greatly appreciated.

I’m not completely sure about the visa process, but as far as I understand, she can stay in India until the expiry date of her A card, but she should inform the commune about her situation before leaving.


For the L card (EU long-term resident status), the 5-year residence period does not automatically reset just because she stays outside Belgium. However, the rules are important: an absence of less than 6 consecutive months generally does not interrupt the 5-year period, provided the total absence does not exceed 10 months during those 5 years.


If she stays outside Belgium for 6 months or more continuously, it can interrupt the uninterrupted-residence period required for the L card. So it would be better to check with the commune before planning a long stay in India.

We were also in the same situation few years ago. But my wife was in India for more than a year. We informed the commune about the absence and had to apply family reunification visa for both wife & the kid, it took 4 months.

It would be best to contact the local commune and get a confirmation.

Also, if your wife stays outside of Belgium for more than 6 consecutive months, then the counter for Uninterrupted stay will be reset and she needs to start it from Zero, please check and confirm with your local commune.
