Working in Oman without having a visa of proper profession

Hi Guys,

One of my friend was working in office, and caught by ministry of manpower during their random visit one year ago and they took his labour card and return back after a week. He was not having a visa of his profession. Now, his visa expired and went for renewal which is already done and stamped on his passport but still he cannot get his new labour card as its blocked in Ministry of Manpower's system.

Company has told him that they are helpless to get his new labour card and he has to go back to his home country.

Please advise if there is any other alternative to sort out this issue.

Your friend has been caught indulging in some unfair practices. Whether it is entirely his mistake or his employer's is secondary.

At this stage, it is pointless to even argue, or worse still, to try to work around a Ministry of Manpower ban.

Your friend better listens to the advice of his employer.

He has not done anything wrong... its just a matter of professional visa. By profession his Draughtsman in the company but the visa arranged by employer is not the correct as his designation, profession mentioned on his labour card is Electrician.

Seems like you require a little bit of explanation here ...

If as you say your friend has not done anything wrong, then why do you think the Ministry of Manpower has blocked his resident card ?!? For fun ??

You say your friend is discharging his duties as a 'Draughtsman'. But his resident card says that he is an 'Electrician'. Don't you think there's some mismatch here ?

Let me explain. What it means is that the company had a labour clearance for an Electrician's position. And the company has misused it to employ your friend as a  'Draughtsman' using an 'Electrician's clearance. That is illegal, as per the Ministry of Manpower. Your friend's employer / sponsor would have been fined for indulging in this common misdeed which many companies resort to.

Your friend's mistake is that he knew that he is not an electrician, yet he has agreed to work on an electrician's designation. And that is exactly why your friend's resident card has been blocked.

That is also why the Ministry of Manpower officials come on surprise checks to catch the employees and the employers who are indulging in such unlawful practices.
