Hello,

I'm Mauritian, living in the UK.  I'm married to a Caribbean and we have two children.  We are contemplating of settling in Mauritius.

My husband has a conviction in the UK which has been spent.

I would like to know if that would adversely affect his application for the permanent residence?

Thank you.

WinstonH

Hi,

Depending on the nature of the conviction, it could have adverse effects on his application for resident permit unfortunately.

One of the required documents for the process is the Certificate of Character or Morality Certificate. If listed on the Certificate of Character, the conviction can negatively impact the outcome of the resident permit procedures.

Moreover, if he is granted a resident permit, he could face further issues in Mauritius when applying for certain types of jobs or when opening/operating certain categories of businesses.

Hi Winston,

Thank you for your reply.

Even if the conviction has been spent?

Depends on the legal system in the UK.

In some countries depending on the severity of the case and the sentence given , even if the conviction has been spent, it remains listed in the character certificate for some time.
In some countries, it remains for life.

You have to inquire with the police or with a lawyer there.
