F+ card rejected after divorce

Greetings,


I have been living in Belgium for 5 years and I had to divorce my partner due to being cheated on multiple times by my partner. We were married for 4 years and my card was almost expired so applied for a F+ card as I received an invitation from my commune. After 6 months I got a rejection letter stating that I have divorced before 5 years therefore im not eligable to F+ card.


Problem is I have fulltime work here and working for more than 4 years, pay my taxes, have no criminal record, finished all language and integration certificates and as well as on top of that I own a house here. 


In the letter it says if I wish I can apply for K card but if that is also negative what should I do? Do I have to sell my house, leave my job and go back to my country for something I cannot control of.


What I find weird is I have multiple collueges here who came here with samenwoning or marriage and divorced even earlier than me and got their F+ with no problem so why do they do it to me now?

Normally your f card should just renew automatically.. What you can do just apply for nationality. This would be easier as for citizenship you need to live in the country for 5 years so.


Better consulting with lawyer would best options

Not possible to apply for nationality directly you must first get the permanent residence which is F+ then you can apply for nationality directly..

From what I think is like you got your resident thru your partner that is a major factor for rejection and normally you must be with your partner for complete 5 yrs before anything..

From my I read both here on forum and my foreign collueges 3+ years is safe, I know two people who got their F+ with no problem after divorce. They were divorced before 5 years with no kids.

As long as you are not linked with your partner anymore and when she or he decelerate it to municipality you will be asked to given your F card.


This is first.


As you said


  • if you legally reside in BE for 5 years (not more or less)
  • if you worked 468 work days
  • if you complete integration
  • if you know at least level 1.1 one of official languages
  • if you have no criminal record


then you are fine with K card.


Dont stock to others story, focus your target.

I fullfill all the points so they wouldnt make a problem with my K card right?

Should I apply with a lawyer in case or do it via commune myself

@user3721 You are perfectly fine.Go over municipality itself.There is no reason to not get it.

@ridewitgab totally possible because i did it.. I have applied for nationality 6 months before my f card expired and i never requested for f+ as i already got my citizenship..

Went to my municipality to ask for a new type of card, they also had no idea of what to do.

I cannot ask for a K card therefore they said I can apply for another F card but not F+. When they saw in the system that I am divorced they also didnt know what to do or if another F card application is possible so they gave me a very late appointment from another desk.


My legal residence rights and work rights are ending by 14 november. I am going to my lawyer to get my rights back, this is unbelievable. I paid all my taxes, did all the neccesary courses and stayed here 5 years and now im at point of losing my job and getting debt to my bank due to my house loan.


I am definetly going to my lawyer after this point.

If you have complete 5 years and other conditions fulfilled then there is no barrier to not give you an K card.

Today I had a appointment with my lawyer and he said appealing to decision could take very long and come up with the same decision in the end. Plus if I ask tor a F card my appeal can automatically rejected.



She said best is to apply for another F card... So I am back to the beginning to orange card and 6 months later it can also be negative...


I am tired of this by doing everything by the rules, maybe its best for me to go back as I dont feel welcomed here. Learned Dutch for nothing in 5 years, paid taxes and they let me buy a house here make all my investing here.

I will just ask them to give me a time until I can sell my house and go back to my country, really dont feel welcomed by the authorities.



I could have offered my ex-wife to wait for me to get my F+ card as it was only 4 months before. But my stomach cannot accept even doing something illegal with someone who cheated on me. I lose because I did everything by the rules. It was a good lesson for me.

@user3721 i dont understand why you are stocked with F card?


As long as you want to live here, work here and continue your life here thanks to authorities they are giving all the possibilities.

What does matter name of the card?


I suppose you are working right? When you still have time at least ask for A or K from your municipality.


Bureaucracy works slow everywhere here also. But this doesnt means you are not welcomed.

The type of card does not matter.

The problem is I already waited 6 months for a rejection and now another 6 months of period and my bank doesnt accept bijlage 15 as my card is expired and they only want a valid Belgian ID so now even my bank account is at edge of getting blocked. That means I cannot get my salary nor pay my house loan if my bank gets blocked soon.


Not to mention that my new F/K card can also get rejected after 6 months. Waiting another 6 months of period where it can be rejected again makes me paronia every single day.

That's exactly what happens when certificates on your current card expires. But it's not a big deal.

As long as you have work contract you are able to get an A card.

As you mentioned before you lived in Belgium 5 years and speak an official language you are able to get a K card.

I highly recommend you contact with municipality yourself or via lawyer

Can I ask please how did your procedure  went,did they renew your f card cause my friend  next year December he has to renew  his f card and the divorce  is finalised .He is very worry what is going to happen  to his f card please kindly  tell me what happen to u.

@user3721 brother .. something went wrong with u ... u divorced and changed ur adress before 5 years ended right ? Did u ask foreign strangers in brussel to keep ur card or u did nt ?
