About the refusal of the intended marriage

Hello,


Today we received a letter stating that our marriage application has been refused. The reason given for the refusal is that the authenticity of our relationship could not be established, as no interview with me was conducted.


However, the Belgian Consulate in my country never contacted me in any way — neither by phone, email, nor letter — to invite me for an interview. My girlfriend was also not informed about any requirement for me to attend an interview during her appointment.


In fact, I sent multiple emails to the Immigration Office asking whether there were any missing documents or additional requirements in my file. I was told that I would be contacted if anything was missing, but I never received any further communication.


My marriage visa application is still ongoing, but our marriage has been refused by the municipality.


What would you advise me to do in this situation?

The reasons for this refusal decision are as follows:

• A thorough (proper) investigation could not be conducted by the Public Prosecutor’s Office.

• According to the letter dated 03/10/2025 from the Immigration Office, Mr. Köse (me) applied for a type D visa for the purpose of marriage at the Belgian diplomatic mission in Istanbul on 09/09/2025.

• However, no interview with the person concerned has yet taken place.

• Your statement alone is not sufficient to provide a clear and complete picture of the relationship.

• The legal obligation under Article 31 §1 of the Private International Law Code to investigate the genuine intentions of the parties could not be fulfilled / has not been completed.
