Hi all,
Good friend of us (third country national) came to Malta as a company offred him a job and therefore he applied for a work permit which he received.
Six months later the employer has ended his contract saing he did not pass probetion period.
What happens now? His residence card is valid for another 6 months.Does he have to return to his home country asap?
If someobe has some knowledge it would be much appreciated.
Thanks

ricky

Hi,

residency for a TCN  on the basis of a work permit is granted for a maximum of 12 months but also dependent on the length of the work contract/permit.

As the employer has terminated the work contract within the probation period he will have to notify ETC that the work permit has been cancelled.

As such the basis of the residency certificate does not exist anymore. How long your friend will be allowed to stay will depend on the department that issues them. Your friend will have to apply for a new work permit as they are specific to job and employer and are not transferable.

To be on the safe side it is advisable to talk to the department. Also think about health insurance ! Is your friend still covered and for how long.

Cheers
Ricky
