Real Estate Lawyer in San Miguel De Allende

Unfortunately we had just learned yesterday that the money (over $500,000) for a build of two places in a new development community just on the outskirts of SM, that the developer and money seems to be MIA. We are gutted as we still live in CA and all this is devastating. So does anyone have/ know of a good lawyer that would be able to help us as we try to handle this awful situation. I wish I had more info but the owner of the la d/ parcels didn’t really have a lot to share or help guide us. Help!

That's horrible and I'm so sorry to hear that. Unfortunately,  shady developers and real estate agents have ruined it for people in our real estate profession. A few things to do right away, before you even pick a lawyer:


Pull together everything in one folder: contracts (promesa de compraventa), every receipt and wire confirmation, the developer's company name and RFC, and all WhatsApps and emails.

Find out whether anything was ever notarized or recorded. Ask a local notario, or have your lawyer check the Registro Público de la Propiedad for the lots.

Hire an independent Mexican litigation attorney in Guanajuato, not someone tied to the developer or the land seller. Interview two or three people and get the fee in writing.

File a PROFECO complaint. They take complaints from buyers living abroad, and developers are required to register their sales contracts with them.

Ask your attorney about a criminal complaint (denuncia for fraude) with the state Fiscalía. That's often what gets people to the table.

Move fast. Assets move fast too. Wishing you the best.
