Change of Employer (HSM Visa holder)

Hi Guys,

I hold HSM Visa valid untill 2023. I got attractive offer from a small Dutch based firm.
This firm is not in the list of IND recognised sponsors.
Am i allowed to work for them? Can i accept offer?
Or Untill i change my Residence permit to a permanent one, i have to stick with my current employer only.

I see this info in IND website - FAQ's.
"If you have a residence permit for highly skilled migrants, a European blue card, an Intra-Company Transfer (ICT Directive) or  researcher/research worker permit (Council Directive (EU) 2016/801) then you only have to give notification of change of employer. Your residence permit remains valid. You do need to keep satisfying the conditions of your residence permit."

Hi and welcome to the Forum.

No, I don't think you can; mainly because a significant part of the visa is a tax break for the company, which they then pass on to you; if they're not registered, then they can't get the deal.  My advice is to get your new employer to speak to the IND.

HI Thanks for reply.

my 30% tax benefit is getting over in next 2 months. So When i join new Dutch employer, he doesnt have to think about 30% tax benefit.
But before i quit., will still ask my new employer to check with IND and confirm.

FYI.. i Came in ICT VIsa - 2017 - 2019.
and then moved to HSM visa 2019 -- 2024.
So i will complete 5 years in next 2 months.

I still don't think they can apply HSM status to yourself if they are not registered; they will not be allowed to apply.  Given the tax-break status you mentioned, the only real benefit to you that I can see is the speed at which the IND will issue your work permit and family permit.  I would speak to the IND; it will save both sides a lot of work if they permitted an early Permanent Residence application from yourself, then you never have to worry about this again.
