Problem with lawyer

Hi can anyone help us , we are having a  problem  with are late fathers lawyer. She has power of attorney on our fathers will and his property  was to be split 3 ways.now he died in 2019 and have been told all she has to do is sign it over to us she has already  had £3000 which she took out of his bank . We have told her that's all she has to do she has gone for the deeds which  we done need as we are not planning  to sale but she just wont listen  to us , can someone  please help we are in England,  but do have property  in Larnaca  in the same building.  And coming  over in next week.

I suspect it'st that the signing over to three people requires that the deeds have to be issued via Land Registry in the name of each party as a third share each

Thankyou  for your reply.  We have been told we dont require deeds  because  we are not selling,  if we do sell the new owners can get them. She is  being  very  difficult , she want to push for a sale so she can get more  money we have also been told that we dont need  her if we want to sell? She is based  in Larnaca  we are in Pervollia.  It's been 4 years and cant get ride of her . Do you know of any body that can help   the developer  went into liquidation and she is in with developer .

Am no lawyer but if it's in the will then probably from a legal point of view the deeds will need to be split ..


If you do sell for whatever reason and they are still in the deceased name I doubt you wil sell easily or quickly as you will undoubtedly have to jump through a rake more hoops to do so ...remember you all have to agree to sell your share

Ah so there aren't any deeds is that the case ..ie problematic property with unauthorised works completed or incompleted works or some other encumbrance....

So in that case you can sell by way of contract of sale agreement/assignment lodged with the land registry  but I still think that you'd have to prove your ownerships

Either way at some time you will have to prove that you three persons own it....maybe speak to the land registry direct and get their view (if there are currently no deeds and the original sale was by purchase agreement contract or assignment) and ask them if splitting the existing ownership document is essential and whether its best to do it now or later
