Divorce/community property

A foreign couple from two different countries move to the Netherlands but marry abroad in one of their own countries but divorce some time later in the Netherlands and agree to leave some of their community property out of the divorce agreement, is this illegal and could the couple make a claim on the withheld assets a couple of years later?

Illegal and not a good idea wherever it's done; when you sign a statement in any court, you are undertaking, to tell the truth, part of which is a financial/asset declaration so that the court can decide who gets what; that agreement will mean both lied to the court and any subsequent court will take a very dim view of that and may well confiscate the lot.

You should also be aware that the taxman will take an interest.
