Rental agreement situation/ Validity

Hello and good evening, I have rented a house in the north here on the island of Mauritius.


A fixed-term rental agreement was signed for a period of two years.


The rental contract was preceded by a "rantel option" that was signed on condition (cancellable after 9 months with a notice period of 3 months if I do not receive another visa).


Now I have seen in the fixed-term lease that, despite a period of 2 years specified on page 1, there is a clause of termination with a notice period of 3 months. This may be used on condition that it can be canceled after at least 6 months.


As far as I know, fixed-term leases can only be terminated extraordinarily, but not properly.


Now what is correct here?


Or...


Is there a formal error that invalidates the contract?


Does the "rantel option" apply in any form to the fixed-term lease?

Hi I am not entirely sure what you mean by 'Rantel Option'.


Also this is without having seen your lease.


Rolling break clauses like this are common and valid in lease agreements in Mauritius. The conditions for the break are normally explicit and straight forward s described. They may seem counter intuitive when the lease is described as fixed term.
