Cant access my allotted parking due to narrow entrance

Post new topic

I recently moved to a premium apartment in dubai where I have 2 reserved parking on the higher floors of the building.  Unfortunately my car a SUV cannot pass through the narrow passage that goes up to the higher floor. I was shown d parking but never assumed that such a premium apartment could have such an absurd issue.

What are my rights in this case? Can I legally get any support if the only available parking spots for me to park are with commercial establishments in the building. The two parking which now is of no use can be rented legally or returned back to owner to get reduction so that I can buy another spot ? What could be a solution in this difficult situation as I really fail to u understand the rights of tenant after paying enormous amount in a premium apartment.

Is it the responsibility of the landlord to help or they can simply push it away by saying u should.have checked.

Please share your advise

As above.

I would suggest to try to talk to the owner to see if he can agree with the building to get the parking slots for you reassigned to another floor by trading with someone else.  Talk nicely.  If the owner doesn't help, talk directly to building management.  And if that doesn't work, go to a neighbor.

In terms of legality, you have practically zero rights.  Why?

1) Normal cars can go to that floor.  Your SUV can't.  It can be argued that it is not a building defect but rather your choice of car - bringing it down to your personal preference.  Secondly, I am not saying anything about your driving abilities but if someone else is able to reach that floor with their SUV, your argument will finish even before it starts
2) You inspected the building and signed a rental contract for the apartment and facilities on an "AS-IS" basis.  If something was removed from the apartment or the facilities were downgraded, you have recourse.  In this case, you don't - the parking is there but you can't access it in your car
