hi,
we have 3 employees who already resigned and their visa are already canceled an open mobility a month ago and they start working to their new employers while their visa still not transfer and they are still using  our company visa.
what legal action we can do?

Your question is not clear. You have mentioned " their visa are already canceled" and "open mobility a month ago".

Can you please confirm whether the visas are still under your company or not?

the other 2 employees are already cancelled but all of them still not transfer, but they are already working means they are working to new company without visa

For the 2 employees who have already cancelled the visa. You can insert overstay after termination in LMRA. If you know where they are working and would like to cause trouble for them and the new employer. You can call 17506055 and mention the details and the LMRA will come for inspection in their place.

1 employee who already resigned. if he has already completed 30 days from the last working day, Call him and inform him that you will be cancelling his visa in a week. Please note that if he is working somewhere else and LMRA catches him in any inspection. You will be imposed a fine as well. When the visas are cancelled and if LMRA catches him there will be no fines imposed on you. Also please do not forget to file overstay after termination.

You can cancel the visa if he has already passed 30 days from the last working day. It is not like the normal runaway. It is just to inform the LMRA that the employee has not left the country and transferred the visa and you are not liable for him anymore.

The third employee you will cancel now, You can file Overstay after termination after 30 days from the cancellation date. You can use the below form and upload it in the esupport.

What I am trying to understand : Did the employees resign and you accepted their resignation?

What is your objective?  To be vindictive or to cover yourself?

To cover yourself, all you need to do is cancel visas and you dodge any fines.  And filing overstay is an extra step which totally covers you. 

Trying to explore filing a runaway case or reporting them is a vindictive approach which is petty if they resigned normally - and this is what paints employers in a bad light.  Unless they didn't, in which case I understand your viewpoint.
