Termination during probation period

Hello Expat Community


I was terminated by the company I worked for during the probationary period(in one month).


Can I transfer my visa to a new employer without their consent? Or can my old company prevent that from happening?

What are my rights?

They are currently holding my passport and salary.

Hi Logical Indian, I read the forum and got answers to most of my questions but I still am confused about the salary part and transferring without consent. Kindly clarify if you can.

Resigning during probation period:


As per the Labour law "The worker may be employed under a probation period if expressly specified in the labour contract, provided said period does not exceed three months. Nevertheless, the probation period may be increased in the occupations to be determined by virtue of the Minister's decision, provided said period does not exceed six month. The probation condition shall only be retained if expressly specified in the labour contract".


In these cases, you can resign with 1 day notice.

If they are holding your passport/salary you need to approach LMRA and MOL.


Once your employer cancels your visa you have 30days grace to leave or find a new employer.
