problem with house

Hello everyone,

I am new to this forum, and am joining it because i have a serious question and a problem. I moved into this apartment owned by (moderated) a group, and this house has a lot of cockroaches in it. It is very difficult for me to live in it now. Is it possible for me to move out of this house immediately. (moderated) group says that is not possible to move out without giving a three month notice. But some of my friends say that this is possible if you approach a lawyer and write some letters to (moderated)group. I really cannot live with these cockroaches at home. Morover, these insects are coming from a source in the kitchen or the bathroom, so i guess using insect repellents will not work (i have tried it!!).
If anyone know anything about how i can solve this problem then please let me know. I am sorry if i posted a question that seems irrelevant to this blog. Please ignore it then.

Hello Ashwin,

unfortunately there is less chance to leave the house without a three months notice. The Germans stick to bureaucracy and their contracts especially if it is a public housing association or something like that.

You must give them a written notice at end of the month latest. Otherwise your contract renews another 3 month.

Nevertheless you should get in touch with a lawyer because there is a good chance that you can keep at least a part of your monthly payments until you move out.
A rent reduction. In German it is "Mietminderung" and it is a very nasty word for every landlord ;-)
In order to make a rent reduction it is necessary that you have proof of what you complain about. Take pictures and name witnesses that should be enough ;-)

The lawyer will tell you how much percent of your rent payment can be kept. If you are lucky your landlord will let you go when they realize that they do not get a full payment anymore.

Some lawyers even offer a first counselling interview for free. Maybe you can find one. Just call them before you make an appointment and ask.

Another opportunity could be the German Tenants Protection Associatíon. They can give advise, too and they also have addresses of lawyers who can help.
