Salaam bro, I would love to know the process on buying a property out in Morocco, I was looking in Anza area a few months ago as I go there quite a lot.

Here’s a step-by-step breakdown of the procedure and what you should do:

1. Signing the "Promise to Sell" (Promesse de Vente)

This is a preliminary contract that secures the property for you while legal checks are carried out.

It is usually drafted by a notary and includes key details:

The identities of the buyer and seller

Description of the property

Agreed price and payment terms

Deadline for finalizing the sale

Any conditions precedent (e.g., obtaining financing, clearing legal issues)

A deposit (often 5% of the price) is typically required. Ensure that this payment is made via bank transfer to the notary’s escrow account rather than directly to the seller.

2. Due Diligence & Legal Checks by the Notary

The notary will:

Verify that the seller is the legal owner (via the title deed - "Titre Foncier")

Check if there are any debts, mortgages, or legal disputes on the property

Ensure the property complies with urban planning and zoning regulations

Obtain a certificate of ownership from the Land Registry (ANCFCC)

3. Securing Financing (if applicable)

If you're using a mortgage, you’ll need to finalize your bank loan before proceeding to the final sale.

4. Drafting & Signing the Final Sale Contract (Acte de Vente)

Once all checks are completed, the notary drafts the final deed of sale.

Both parties sign the contract, and you make the final payment (including taxes and notary fees).

The notary registers the transaction with the ANCFCC, and you receive the new title deed in your name.

5. Additional Costs & Taxes

Notary fees & registration: Around 4-8% of the property price

I paid around about £1500.

Property tax & stamp duty (if applicable) Seller.

What You Should Do
