How to buy land in Paraguay ?

Hello everyone,

In an article written by Paraguay Mike, it is written that it is common for Paraguay's lawyers to ask for a large sum of money in advance or charge up front taxes or fees in advance.

He adds, "If this happens, you must go away, and if the lawyer does not give you a receipt, you must flee." So he recommends choosing wisely his lawyer.

So that means that you always have to pay for a result. But how do you know that he did not invent legal procedures or taxes that do not exist?

What is the role of a lawyer in a process of buying a property?

Paraguay Mike adds that the sales process is simple:

- you find a property that suits you

- you agree on a purchase price with the owner

- you go to a notary public to sign a private contract for the purchase of the property

- you pay a deposit of 5 to 10% on the property

- the notary then asks the public archives office to fill out a property information sheet

- if all goes well, the transaction continues. If there is a problem, it is to be hoped that the seller will return your deposit as required by law. Otherwise, you have to sue for a refund, which involves finding an honest lawyer, paying the lawyer's fees immediately, and waiting years before the verdict.

So the notary does not protect his client by getting information on the property before the buyer pays a deposit of 5 to 10% on the property.

Does a foreigner have the right to ask for information about a property at the public records office or is it possible to pay a lawyer or notary to do this work before paying the property advance payment ?

On the internet, there are websites or Facebook pages of Paraguayan notaries but there is no article written by a foreigner who recommends a particular notary.

What must you do to find a reliable Paraguayan notary?

On this website

http://www.nacimiento.com.py

it is written "consulting company responsible for providing support to the future client interested in carrying out housing projects,"

Is it a house building company or is it an intermediary between a builder and people who want to build a house?

Thank you.

Best regards,

Michel

Although the lawyer's office does take care of administrative tasks such as preparing and processing forms and documents and collecting and disbursing closing funds, the lawyer's ultimate role is to protect the purchaser and ensure that they obtain good and marketable title to the property on closing.

Hello Michel,

Could you reference the article by Paraguay Mike regarding Paraguay's lawyers when buying land?

Thank you.

Hi, I wrote a post about all the practical details of property purchase in Paraguay a couple of months ago. (I am not a real estate agent and I don't sell lands, etc)
