Tenancy rights

Hye friends,
I just wan to know about tenancy agreement as per Malaysian law. Im one of the tenant for in a house and we never sign any contract or agreement when we enter the house. Now currently we are planning to move out because of some problem..should we give minimum notification to owner and is it our deposit the owner should give us when we leave that house.
If we are wan to move out within two weeks, is it possible the owner will give deposit.
We are never sign the agreement or contract for this house until now.

Hi, firstly I would suggest that you always sign a tenancy agreement so that everything is in black and white, and there are no surprises for either party.

Usually, there is a minimum notification period to be given to the landlord if you want to move out. It can range from 1-2 months notice. If you want to move out within 2 weeks, then you will need to negotiate with the landlord. They may compromise. If not, they may not refund your entire deposit.

When you rent any property, you will normally be asked to pay pay a 2 month security deposit, 1 month advanced rental and 1/2 to 1 month utility deposit, which equates to 3.5 to 4 months. The security deposit is used to cover for possible damages to the property & amenities as well as insufficient notice period given, whilst the utility deposit is used to cover any unpaid utility bills. All this is covered in a tenancy agreement.

Anyhow, perhaps the above advice comes a little late now. If it has not, good luck in your negotiations with your landlord.
