30% tax ruling Netherland

Dear, I would need your help to understand if I'm eligible or not to the 30% ruling in Netherlands.

I am a French lady, working and living since 3 years in Belgium, benificiating of the Belgian special regime tax of "non resident". I just got a job in the Netherlands, and I understood that we can't be eligible to the ruling if we have lived the 2 last years at less than 150 km from the Dutch border.

As I have a "non resident" statue in Belgium, I was wondering if I can declare my home previous my move to Belgium, which is in South of France?

Many thanks in advance for your opinion.
Sincerely
Audrey

Hi and welcome to the Forum.

My opinion is no, you will not be entitled to claim the 30% tax status.  If you're interested in why, then, unfortunately, the 150 km rule requires you have physically lived more than 150 km from the nearest Dutch border point for 16 of the previous 24 months; your status while living there is irrelevant as far as the rule is concerned.

Hope this helps.
