Temporary or Transfer of Residency

Me and my partner Lorna have just bought a property in Mandria, Paphos and will be there most of the year.

We retain a property in the UK for when we go back to visit relatives, weddings, funerals and all that sort of stuff.
The Perminant residency in Cyprus needs a civil or Marriage certificate that we don't have and don't want to go through it again both being devorcees.
So I suppose my question is how long can you keep applying for temporary residency on an annual basis or is there a cut off at some point.
There must be disadvantages just doing temporary to transfer of residency, healthcare etc.

Temp Res under pink slip can be applied for and renewed annually..as long as you fulfil the renewal criteria until 5 years have been reached when PR can be applied for ..... I dont see why you can't simply apply for TR AND THEN  PR individually when the time comes..as long as you have both got individual proof of supporting income
..  I have read somewhere and I will need to find the reference that they can reduce the validity length of time.... the pink slip I believe depends on not leaving Cyprus for More than three months .. if that happens it is automatically terminated

If you're not married then this won't affect your residency application... Even Cyprus bureaucracy isn't that crazy, or an I misunderstanding the question?

To apply for permanent residency we would have to get married or get a civil partnership certificate according to our Lawyer

The only reason for that I can see is if you don't reach have the individual income levels to get individual residency.

Nah I doubt that ... Lots of people move here and are not married ..unless you cannot individually prove income.

One option which you may like to think about and explore if the above is the case you could see about going to a court in Cyprus and both signing an affidavit saying that your non earning or lower income earner is supported by you . Its a simple process and not expensive

Nb If early termination is effected for leaving for more than 3 months then that may be an issue at next renewal or new application ... and I think that's what I read that they are then at liberty to reduce the validity of the next application

I will try to find that reference as am not 100% sure .. am only sure that I believe that I read that just can't remember where

Thank you for your imformation dealing with a lawyer in Cyprus is very challanging.

My partners pension doesn't meet the required amount but mine does and more. The house will be in both names and the lawyer wants my partner to be a family dependant ie Me €10000 in a bank account and her €5000.
In reality we'd like to be dual citizens UK and Cyprus but Brexit came along

@timhuntington i would suggest asking your lawyer about the affi davit route if that is a valid option ... I do know it worked for a friend who did all the necessary work with Gwennys Red Tape Services . Maybe try them

Dual citizenship can still be obtained if thats what you mean but you must be legally here for 7-8 years take person to person interview in Nicosia  in basic greek have police conduct checks have a basic knowledge of Cyprus politics social and cultural things as well as knowing it history with The Cyprus problem... place adverts in the same gazette for two consecutive weeks notifying everyone of your intentions, have the 7-8 years proof of living here bills etc about €1500 in fees incl lawyer  and then to wait to see if application is accepted or not as there is no guarantee.... A friend of mine who used to work for the British High Commission here in Nicosia has been waiting four years for hers and is still waiting.. and get this she forgot about her visits to the TRNC. As when she was asked she said she hadn't visited  but they knew she had with dates...   Make of that what you will

Your pink slip residency counts towards PR and citizenship  as long as you haven't had it terminated by exceeding the absence of three months

It's the "F" catagory PR the lawyer is putting us forward for thats why he wants a marriage certificate.
I'll ask him Monday if the Affidavit root can be sort in a Cyprus Court of law so my partner is solely dependant on me financially.
He said "doing temporary residency individually would be fine"
After 5 years would we still be in the same boat as what we are now?

No I don't think so because your pink slip.years count towards PR .... As long as you can both prove every expense of living here permanently legally and continuously with no more than 3 months out of Cyprus each year

We would only pop back to the UK a month at a time say 3 times a year maybe not even that, so wouldn't go over the limit. We will be having pension monies coming into Cyprus monthly and spending in supermarkets, restaurants etc so can prove our stay and spending.
I think the healthcare could be a problem, 2 years fees then  could we still swap NHS for Cyprus version free or have to pay private for 5 years being temporary res

Thingss to think about ....  Can you prove a durable unmarried  relationship of more than two years prior to application  ie joint expenses bills In both names or payments being made for joint expenses, rental agreements or mortgages in joint names.... All these things can make a difference

Healthcare . If you are on state pension then form S1 will get you state GESY healthcare at low cost it's never free..... Had you been married only one of you needs to be on state pension and both would get the state GESY healthcare. Cat F application as with pink slip route disallows working so paying social contributions for GESY via work is not an option and neither is voluntary contributions as they currently are not allowed.....  So private healthcare which must now include repatriation is essential if not on state pension or working...

When I say income... That income can be from accumulated savings pots and regular income  it doesn't necessarily have to mean solely  a paid salary or pension it can be from both that and savings...(. nb i would strongly argue that point with proof and.that you both have a valuable asset in UK that if necessary could provide further income / savings if necessary)  They need to be satisfied that you both have sufficient funding for your intended stay not to be a burden on the state of  RoC

Just a word of caution .. criteria is due to change for the worse...well worse than now and considerably worse than when UK were in EU...

It has passed through cabinet but has still to pass through parliament.. feelings are running high over it and it could be that the new financial criteria may be reduced from the cabinet proposals but may still be higher than now. . So best advice is to get things moving as quickly as possible..... And yes lawyers here can be painful.....

This is the response I recieved this am from the Lawyer asking about the Affidavit in a Cyprus Court of law asking that my partner would be dependant on my finances etc,

"I hope my email finds you well .
Regarding the permanent residency, this way unfortunately it will not work and her application will not be accepted as she must have her own property to apply .
As for the temporary residency as I informed you in my previous email she can apply as dependent and we can re- new the temporary residency permit  every year".

I'm not sure what he means here, we're both buying a property together with both names on the deeds.
Looks like we will have to go down the temporary residency root and take it from there or we go to the Town Hall in UK and get a civil partnership certificate. Crazy!
Like you say though there's lots of couples in Cyprus not married and living together with property but was this before Brexit?

Note on living together.
We have had 2 homes for the last 19 years Lorna brought her 3 children up in her home. I brought my 3 children up in my home. We did Fri to Sun together then lived mid-week on our own.
The kids have all left the nests now and we've only just come together In the last 6 months.
Lorna lived in rented, now gone and I own my own home that we live in now. So we can't prove bills and all that together.
Cyprus will be our first home together if we ever get there, I'm sure we will!

But she has a property half in her name ...... is the property you have bought in joint names in excess of €250-300k as this would allow both to apply for Pr and GESY under the investment rules

We haven't got the property yet.
We've paid €10k for deposit to take property off the market whilst all DD can be done before we sign final contracts.
We've paid €267,000 for the property but I said in my naivety the property would be 75%-25% ownership. If that's what the problem is I can change 50-50 ownership.
I am 63 and Lorna is 55 so not at state pensionable age for me another 34 months and Lorna would be 67 years of age before she gets to S/Pension, miles off

So its looking like Temp Res for however long you want to do that....  And in doing so you.will eventually have the history and proof You need for PR... But in all honesty I don't find much difference between temp and perm so am not really convinced of its importance or value



I would be tempted to take a different route via Gwennys

I was going to import my car over 5 years old loaded with stuff from uk but I'm not sure I can do that under temporary residency, will have to see. Thanks again

I would say checkout PR under the investment in property route as half Share each...

Private health care then .... Check out @anthonyfarrow  as he got a cheaper than usual healthcare plan.. there is a healthcare insurance available for under €200 per yr it's basic but i do believe it satisfies healthcare requirements for immigration dept for non EU nationals.. try speaking to Abbeygate  or Atlantic or Pacific or top quotes or anytime insurance or status

Sounds like a hefty deposit . And sounds like Fitzgerald's ....  Normally when buying its either in one name or in joint names as equal shares .. its 50% cheaper in terms of transfer Fees if in joint names

Have a look it may be worth considering, I know it's basic .. but if you are both in good health why not. .   we did this for about three years until S1 kicked in and GESY .

Under a transfer of residency Tor1 form you can bring a car over with personal effects in it over 5 years old, you get one shot at it and must go on a R-Rak shared container shipment. Takes 18 days to arrive in Limassol then pay a small fortune getting it on the road but cheaper than buying a car in Cyprus. Some prices in Cyprus are mouthwatering just for a very old car

Thats a new one .... Learning every day ...... Transfer of residency ... One for the manual that one .. cheers......  As I understand it now... If you are relocating your whole permanent residence you can. You must have owned the vehicle for more than 6 months which I assume it is.. you must also leave the drivers area free ...  NB All confirmed by a friend in the shipping business.. so good to go Tim

So the 5 yrs rule must be applied to imports not related to residency transfers...

Depends a lot on what you bring I suppose and what the charges are.... We ve only ever bought new cars here at a reasonable price..  I know used cars do retain their value rather well..

Having bought pups elsewhere I will not buy used again....... The two we have had here were bought here new and by and large have given us 8yrs trouble free motoring

Pink slip is €15k available for each year deposited into the Cyprus bank of choice at start of each year at renewal... As long as you can prove it comes in to Cyprus from abroad

If you can prove more then you wil be fine

I think the new criteria will not apply to new applications .. but who knows..  things change ... My gut feeling is that the new criteria as published in the media will not be passed through parliament in its present form . I suspect they will reduce it but may still be more than  pink slip current requirements... I further suspect to a similar level to that of Spain.. currently at €27k
