Non-EU spouse of Belgian citizen living in the UK visiting Belgium?

Guest6782

Hi all,

I am a non-eu citizen family member of a Belgian citizen and we live in the UK. Now that brexit happened, I know I need a visa to travel to EU countries but I am confused about how to get one?

Once covid dies down a little, we would like to visit his family in Belgium but then travel onto Italy for a holiday with a car.
What kind of visa do I need to get as the family member of a Belgian citizen to enter Belgium?

And because we would spend most of our time in Italy, do I actually need to get a visa to Italy rather than Belgium?

Thanks in advance for any answers

Hello,

you'll need to request a tourist visa C (short stay - 90 days).
As you'll spend more time in Italy than elsewhere in Europe, you have to request your visa to the Italian Embassy/Consulate in England.

You should join the certificate of marriage to your file to proof that you're married to a Belgian citizen. Your file would be processed in priority (EU agreement)
He should also add a document stating that he'll travel with you + full description of the trip / booking / ...

And of course, add as much information that state you'll leave EU before the end of your visa. (work, payslips, house, accommodation, ...)

Now, it might be really easier to state that you'll spend more time in Belgium rather than in Italy.
You'd be able to do the visa request to the Belgian embassy and avoid a lot of sworn translation + apostile, ...

Thank you Alex, I thought so too, I had friends who got a visa for France but travelled to Spain. And I will definitely visit Belgium so I may do that, I may even stay in Belgium longer tbf.

The visa, I assume, is not always a multiple entry 6 month valid visa. It could be for that time period I am travelling, right?

If it's your first ever Schengen visa, you have to request the exact number of day you'll stay in EU. (You should do like everybody: one month maximum / unique entry visa, except if money is not a problem at all => payslips / bank statement / ... Keep in mind you must be able to proof you've 95€ per day for your trip)
You must do some kind of excel table where you state where you'll be for each day of your trip + booking / family house / ...

If you've already been in Belgium, add copy of previous visa, pictures in EU, ... Proof everything you write.
They nearly never grant 1 year / multiple entry visa if it's your first visa request.
First, you've to proof that you can be trusted (respect the laws & you always go back in UK), before requesting such visa options.

Thanks Alex, very very useful information, appreciated.

I've lived in Belgium for 3 years and I've travelled across EU after I moved to the UK without visas because I had the Residence card of a family member of a union citizen. Of course I can't do that anymore. I do have my new status in the UK with a card so that's also ok. I am employed in the UK and finances won't be a problem to show.

But an excel file makes lots of sense, thank you.

Would it help if I added my older passports showing my travels and my long stay visa to Belgium from back in 2013? I have quite a few stamps from different travels I've made to the EU but across 4 different passports :)

Then it's piece of cake!

Add proof that you've already lived in Europe (copy of passport + visa, old ID card, old flight tickets, ...) and you're currently working, then the visa is easily granted.

Keep in mind that rich countries are scared of people that want to stay illegally or overextend their stay.
Quickly describe why you want a tourist visa, where you'll go and how and focus a bit on the money part + family member of EU + already lived in EU before and that you'll go back in UK.
It takes from 5 calendar days to 21 days to get your visa.

Thank you so much Alex, then I will do that.

I will put in my travels across the EU which should help my case immensely alongside the other documents needed :)
