Hi All,

I've observed varying requirements for the Digital Nomad visa across different consulates.

Specifically, the London consulate mandates a letter from the employer confirming that all functions can be performed remotely.

'Notarized letter from the employer in the UK, stating the applicant’s full name and functions in the organization, as well as a statement in which the employer attest that all functions of the employee can be performed remotely in Brazil.'

Interestingly, this stipulation doesn't appear in other consulates. Additionally, a Brazilian attorney I consulted mentioned this isn't a legal requirement and that I can self attest. Any guidance on this?

The issue is that my contract states that I need to come to the office when required to do so. This is once every 3 or 4 months which I am happy to comply with.

According to the resolution 45/2021,


You need one document where you self attest your remote working capabilities (I), and your work contract with a foreign employer (as it is) (II). It does not say that your work contract needs to include such section. So legally speaking, the attorney you consulted is correct.

However, with the legal flexibility that foreign consulates have abroad, they do ask for extra or other documents as they deem appropriate.

You can try your chances with your own declaration letter and the existing contract, maybe they'll accept it as it's kind of obvious from your contract that you can work remotely, but it's a possibility that they won't find it sufficient and will ask you to present the document as specifically listed on their website.
