Employee transfer - pending notice period completion 90 days

hasanaskar4

Hello,

I have been working at my current company since March 2020. I have completed 4 years, and my contract is valid until March 2026. I received a job offer from another employer through Qiwa, which I accepted. The status in Qiwa now shows “pending notice period completion.”

Could any experienced person tell me whether my current company can ask for compensation for the remaining contract period?

Under Article 77.(2) of SL&WL, for termination of a fixed-term employment contract, compensation becomes due to the current company for the wage for the remainder of the contract term.

Also, the current company may issue a final exit to your work visa while you are waiting of pending notice period completion for your transfer of sponsorship in QIWA portal platform.

Even if I works to complete my 90 days notice period I may need to pay the compensation.

@hasanaskar4, completing the 90 days notice period has nothing to do with your OP question. So, from the current company perspective, the issue is not about notice period, it is regard your current company can ask compensation for the wage of the remainder of the employment contract term as stipulated under Article 77.(2) of SL&WL. They are just preparing the ground for you to pay them before they issue a final exit for your work visa.
