New Law for building new struct in empty land in the country

I need some help figuring some things out. I was in the process of selling some vacant property in the country in Laconia to my cousin. Transfer of property was taking a very long time. I received a call from him recently saying that he was backing out of the deal because apparently a new law is passing where you're not allowed to build on vacant land unless it's close to national highway or it already has an existing structure on it. So does that mean that nobody's allowed to build in the village if they own vacant land, especially in the desirable part of the village near the beach? Can anybody help me to confirm this is true?

You should be conducting this through a lawyer and not an expat site, you will not get any legal advice though here.

@Kostas1234 That sounds like absolute nonsense,I have built a house here in greece and bought and sold apartments and my house,a good local mechanic will be able to help you if you pay them a fee for their time and a lawyer,mechanics are super at all the building laws,new and old.He probably hasnt got the guts to own up that hes changed his mind after keeping you waiting,hanging in there while he sorted his life only to realise his finances dont allow or hes found some other game to play.Lies and more lies as usual.

Where are you located?  We are hoping to buy land in Corfu with the hope of building our retirement home there someday.  We are from Canada so there is more to the process but I would hate to buy a parcel of land to find out that there is literally nothing I could do with it later.  Contacting a lawyer or engineer is probably the best option.

@Deda May You need the lawyer and the mechanic from your area where the plot is.You cannot just go and buy land or a house on your own,this may be the land of sunshine but it sure aint the land full of honest people,nowhere is.

I asked and the Engineers told me you can build on agricultural land if you have at least 4 Stremata which is approximately 40,000 square feet but it must have at least 25 meters of the property on a usable road.

@ZeusNYC1 you have been misled - you cannot build on agricultural land - pls get advice from a competent lawyer (not a salesman who wants to close a sale…often at any cost!)…you have been warned

I looked at the site plan and the property is approximately 4,900 square meters.  I thought it was a decent size plot of land but apparently not.

"SOS: NEW LAW FEK 245Α’ (N.4759/09-12-2020): What you need to do to save your property under the provisions of the new Law:

According to the new Law, there are the following cases for plots located outside the settlement:

1.- If your land is regularly buildable, ie if it has an area of 4,000 sqm and a facade of 45 m. on International, National, Provincial or Main Municipal Road, you do not need to issue a permit now, you can do it even after the expiration of the Law 4795 which is 31/12/2022.

2.- The new Law 4659/20, cancels all iregular buildabilities. If your plot falls under one of the following iregularities, then you only have until 31/12/2022 and you need a certificate of pre-existing land (independence).

2.1.- If your land is 4,000 m2 but does not have a 45 meter front on a National, provincial or Main Municipal road (which is the majority of cases), then you need a 2003 land pre-existance certificate.

2.2.- If your land is over 2,000 m2 and is located in a zone of 500 m from a settlement pre-existing1923, then you need a 1977 land pre-existance certificate.

2.3.- If your land is over 2,000 m2 and faces a National, Provincial or Main Municipal road, then you need a 1978 land pre-existance certificate.

2.4.- If your land is over 1,200 m2 and faces a National, Provincial or Main Municipal Road, then you need a 1964 land pre-existance certificate.

2.5.- If your land is over 750 m2 and faces a National, Provincial or Main Municipal Road, then you need a 1962 land pre-existance certificate.

This certificate is issued by the Technical Services of your Municipality. It is obvious that it will help a lot if there is a contract that has been made before the requested date. If not, you should find one of your neighbors who has a title before the requested date and mentions you or one of the previous owners as neighbors.

If your land falls under one of the sub-cases 2.1 to 2.5, you need to issue a building permit until 31/12/2022, otherwise, unfortunately, your land will no longer be able to built."

hello, I am buying a plot in Greece, but it is located 200 m from the road, it is under construction, it is 7,000 meters long, will it be possible to build it? and how to get to the plot since it is 200 meters from the nearest road and house, can anyone help?

@wwocash Do you have an entrance leading you to the land from the road?If not the only way to be able to actually get to the land is to ask an owner of land to sell you a strip of their land for your use as an entrance if it comes off the road way.Sometimes the council have already ear-marked roads through a plotted land area and you may have the right to make your entrance to your land plot from the road and the other land owners can say nothing as you go through their land,you must speak with a mechanic engineer and land lawyer who will inspect town planning papers and inspect at the town planning your plot.What do you mean..its under construction...construction of what,surely not your house as you dont appear to have an entrance.

It is like deda May say, for the moment, it is not allowed anymore to build on a plot of land less then 4000sqm and if your plot dont have a border to a recognised road. The government will give an update between september and end of the his year. If you want to buy, wait until January 2024 to be sure where and how you can build.
