English husband moved here, but now we want to move back

Hi there,

I am not sure how active this forum is, but we are looking for some insight.

My husband is from England and moved to the US three years ago on a K1 fiancé visa. We have really enjoyed our time in Florida, but have agreed it is time to prepare to move back to England. I know that I can apply for a spouse visa, which is fine. But because my husband is here with me we aren't sure if there is something different we need to do for him. He is still a citizen but is a US resident at the moment.

We also don't know how to meet the financial requirement. Because he doesn't have a job in England, he doesn't meet the salary requirements. We are thinking we then need the £18000 just on hand, but the website says if it's an amount over £16000 we need to have it in the bank for six months before we can apply.

Has anyone had any experience with a similar situation? We did the whole American visa process without a lawyer, but this time it seems more complicated. Thanks!

Hi and welcome to the Forum.

Assuming your husband is still a UK passport holder, then he has no restrictions on his returning to the UK; there are no forms to complete, no calls to make, he just jumps on the aeroplane and walks through the UK passports channel when he gets here.

You as a US citizen will need a visa; the details of how are on the UK Gov website; this link will take you straight there. The link describes the income requirements; you can loosely translate that to mean he needs to get a job that pays over the required limit for your family group; that's normally proven by his job contract and copies of bank statement showing the money going into his account from his employer.

In regards to the financial requirements as you said, "you can loosely translate that to mean he needs to get a job that pays over the required limit for your family group" -Does that mean we have to be separated? He will have to go back and get a job before I can even apply? We are trying to avoid being apart.

It doesn't actually say that in the UK Gov link, although for most that is the reality. If you read the link I gave you, it explains what can be accepted as being "income".
