TRC was never canceled

I had a one year contract with a school. Along with my work permit I got a 2 year TRC. When I did not renew my contract with the company they never canceled my trc or took it back. As far as I know, this is still a valid visa. However, I'm worried about what happens when I eventually apply for a new work permit. Will I run into problems getting a work permit for a new company?

If you cancel that TRC you will have to go onto a tourist visa which they are not handing out that often these days

Would I need to cancel my trc to get a new work permit? Isn't there a 30 day grace period after that? Perhaps I could get a work permit and new trc in that time?

I had a TRC with another company that last until 2022. May 3rd 2021 I changed job and is currently in the process of getting a new TRC issued. But the old one is still valid until the new one is issued..

FYI - it is impossible to change to a tourist visa if you were on a business visa before.

FYI - it is impossible to change to a tourist visa if you were on a business visa before.

You can go from a business visa to a tourist visa by leaving and reentering, but thats not possible as the borders are closed.

Hi, I am in the same situation I left a company 8 months ago. My Work permit was cancelled but my TRC is still active,

So now I am in the process of going through all the document certification process and police check etc... again with a new company.

So when they apply for the new work permit I'll be on my TRC that was with the old company which was 8 months ago. My trc is still valid until the end of year. I had the same question "Is it OK to use the valid TRC until my new work permit is approved with the new company?

hey did are you just doing a transfer on work permit? Or did you leave your previous employer for a while already?

Apparently they cancel the work permit if you leave and don't transfer but you can stay out the remaining of your TRC. bit confusing to be honest

Hey.
The TRC was with the sponsor company so you can't extend the TRC you have but you can stay till the period expires.
My problem is that my TRC expired the end of May so I'm on overstay now.
I tried to get a visa at immigration but they don't give now.
The immigration advised me to go to an agent or travel agent. But they are asking silly money just for 15 days so I can't be bothered to renew the visa.
What will happen I don't know.

Hey ATM the visa companies are really playing up to making money now as the covid situation has caused so many problems,

Not sure if you have a Grace period or are granted a extension because of the covid now. It's so confusing ATM with what's right and wrong in terms of visas.

I am starting with a new company now so I as long as my TRC is still active until the new company completes the new work permit I'll be happy. Then they'll issue a new TRC with the new work permit I am thinking and the old TRC will be removed.

I told the company but they Never really said much about the existing TRC. Just said it would be ok ?

This gets a little confusing but I'll try to make it as clear as I can.
- The WP (Work Permit) is directly connected to and based on your labor contract. When you leave that company your labor contract is automatically voided, thus your WP is also voided.
- The TRC is directly connected to your personal credentials and is good until it expires. The TRC can be used when applying for a WP with a new company but when it does expire you will need a sponsor to renew it. The sponsor can be any company 'or individual' who is a perinate Vietnamese resident in the area where you live.

How do you check to see if your company cancelled your TRC? Mine is valid until 2022, but I have no idea if it was cancelled or not when I left the company.

Heard a lot of ways to get a TRC but thats a new one on me. Had to look up the meaning of "perinate" & even now am still confused.....something about a vagina is best I can see

In October 2021 the school closed down and terminated both my Employment Contract and WP officially at the government office. The school sent me a copy of the reply letter confirming cancellation.

I am still in Vietnam using the TRC. I just got married and want to apply for a Spouse TRC but the Visa Agents are informing me that I must first ask the school (no longer exists and the owner now lives in Singapore) to cancel my TRC. Is it possible for me and wifey to visit the local (Danang) immigration office and request to cancel it myself?

Alternatively, I leave at end July (hopefully no issues at the customs border control) and return on a 30 day tourist visa and apply for a Spouse TRC (TT) then.

What are your thoughts please?

Have you spoken with Immigration? Agents are only after one thing $$$$$ It is best to talk with the people who can make a decision. Take all your documents with your wife and go talk with immigration.

**UPDATE**

I visited Danang Immigration and as soon as they saw me (even with my wife) they told me to go to Room 2 who speak English.

So I did and waited for my turn like foreigners do LOL, as I approached the desk, the IO asked me "who am I here with?", I replied "my wife" and he called her over and they proceeded to have an entire 15 minute conversation in Vietnamese....bear in mind that my wife doesn't speak English but knows why we were there.

As a result, my TRC is still valid, although the school closed down. He recommended that I contact the school owner (whom I cannot as she is in Singapore) and she can cancel the TRC in Danang Immigration Office (they simply post it to Hanoi). He said that I would be fined and possibly blacklisted from VN if I didn't do this very soon.

My wife said that this procedure is not possible and he then said that I must visit Hanoi Immigration Office (without a school rep) and cancel it there before I can apply for a TRC type TT.

So, as my TRC expires in 7 weeks, I will just wait and depart VN at that time. I will then return on a 30 day tourist visa and apply either in Hanoi or through the use of an agent (because the flights / hotels / taxi cost outweighs the agent fees).

You have a Vietnamese wife so why don’t you have a TRC for being married. You can travel in and out with that.

You say it’s impossible to go to Hanoi. Immigration has already told you that you might be blacklisted. With family here I would only be thinking of them.

Good luck and hopefully everything will work out.
