English girl marrying Albanian guy

Hi myself and my partner are due to get married soon we have children together we gave notice and had a interview with the home office and have been given right to get married here in the U.K. ..
however he was advised that he will need to return back to his country as he entered the uk illegally ..

Due to the fact we have the children they have not detained him and he has to voulnterily go back to his home country but they have kept his passport.

What I am wondering is does anyone no after we get married and apply for spouse visa how long will he have to go back to Albania for before he will be able to return back to the uk with entry clearance ?

Any advice will be helpful ? Thanks .. ahaca x

I was told that he will have a 2 year ban but marriage in Albania will make it An exception to the rule.

I think he will be ok and better to remain here.
Get married asap here and then apply from here for a spouse visa/right to remain.

If he goes back to Albania it can take a long time to process. Min 3 months.
Also, he could be refused due to breaking immigration law and being here illegally.

I have a friend who was here with her alb bf in the Uk for many years, he was illegal.
They married here and applied from here and he was given status here.
They also had children together.

My hubby was here illegally also.
He got sent back to Alb. I went there and married him and we applied for a spouse visa but it was refused.
He was caught here with fake ID so refused on that reason.
They also pointed out that he had circumvented immigration rules being here as an illegal.
we don't have children together!

Get a solicitor, don't take any chances.

From personal experience, it takes months, or years for the Home Office to process your application and it is very difficult to track the progress of your application.  If for any reason your spouse needs to travel in the meantime (family emergency, perhaps), the application would have to be withdrawn.

The UK government appear to prefer it if your spouse goes home and applies for the spouse visa from there.

As to how long it will take for him to get his visa, in Albania and return to the UK, it is difficult to say.  As per the above advice a lawyer who specialises in immigration would be helpful, particularly in light of your spouses previous illegal entry to the UK.

Also, consider getting your MP on side!

We are married now and application is sent fingers crossed we can get him a status .. this is really stressful what part of Albania is your partner from? X
