English girl marrying Albanian guy

Hi myself and my partner are due to get married soon we have children together we gave notice and had a interview with the home office and have been given right to get married here in the U.K. ..
however he was advised that he will need to return back to his country as he entered the uk illegally ..

Due to the fact we have the children they have not detained him and he has to voulnterily go back to his home country but they have kept his passport.

What I am wondering is does anyone no after we get married and apply for spouse visa how long will he have to go back to Albania for before he will be able to return back to the uk with entry clearance ?

Any advice will be helpful ? Thanks .. ahaca x

I was told that he will have a 2 year ban but marriage in Albania will make it An exception to the rule.

I think he will be ok and better to remain here.
Get married asap here and then apply from here for a spouse visa/right to remain.

If he goes back to Albania it can take a long time to process. Min 3 months.
Also, he could be refused due to breaking immigration law and being here illegally.

I have a friend who was here with her alb bf in the Uk for many years, he was illegal.
They married here and applied from here and he was given status here.
They also had children together.

My hubby was here illegally also.
He got sent back to Alb. I went there and married him and we applied for a spouse visa but it was refused.
He was caught here with fake ID so refused on that reason.
They also pointed out that he had circumvented immigration rules being here as an illegal.
we don't have children together!

Get a solicitor, don't take any chances.

From personal experience, it takes months, or years for the Home Office to process your application and it is very difficult to track the progress of your application.  If for any reason your spouse needs to travel in the meantime (family emergency, perhaps), the application would have to be withdrawn.

The UK government appear to prefer it if your spouse goes home and applies for the spouse visa from there.

As to how long it will take for him to get his visa, in Albania and return to the UK, it is difficult to say.  As per the above advice a lawyer who specialises in immigration would be helpful, particularly in light of your spouses previous illegal entry to the UK.

Also, consider getting your MP on side!

We are married now and application is sent fingers crossed we can get him a status .. this is really stressful what part of Albania is your partner from? X

It would have been much easier if he had applied for a LEGAL entry in the 1st place in Albania.

He wasn’t refused he is still awaiting an awnserr and still signing at the police station .

Hi Sannie and welcome to the Forum,

You met in London; does he have a visa to live in the UK?

Hi... no he is staying illegal there but how he can have a permission in the UK? He have only to live with me in the UK ? Or we need to be marriage?

Then you have a problem; if he is in the UK illegally, then he will not able to gain legal permission to live in the UK; in fact he is running the risk of being caught and permanently deported with no chance of ever entering the UK again.

If he wishes to live in the UK, my advice would be for him to leave and then apply to enter legally.  Whether he will be able to qualify for a work visa is another matter as I suspect if he was able to qualify, he wouldn't be in the UK illegally to start with.

Immigration into the UK is very difficult at the moment; even if you married him, you would have to be together for 2 years before he could apply; perhaps you should consider another EU country; you say you're Dutch, perhaps try there.

ATM he is held at a detention centre in Heathrow, my old solicitor messed us up so I had to change to Malik and Malik. Because of the old solicitor it isn't looking very good, and we haven't made an application yet. We have been together for about two years ( not married) we don't have proof of the 2 years except pictures, as all our call logs and other information we don't have because of changing to new phones. I'm 18 and his is 22, what advice would you give me because I'm new to all of this x

He has been court once and sent back to Ireland, and he has reentered again illegally? You have pretty much blown it. Sorry to say. The UK government is cracking down hard on this. You should have had him stay in Ireland and worked on getting him a visa etc....

Unless you have concrete documentation that you have been together for 2 years, things do not look rosy, What has your lawyer said?
