Residency Permit Criminal Background

Hi Guys,

Ive seen some posts on this but my situation is a little different. 15 years ago I had an arrest in the US for a felony crime, the case was dismissed but my guess is that FBI records would show the arrest(Its federal and most likely cannot be expunged).

Im applying for residency through investment here. Ive seen various requirements that local or state criminal background check would do and sometimes it needs to be an FBI. If its local or state it most likely wont show up on the records, FBI yes.

So my question is, can I apply for the permit with US local or state records? And should it be done in Brazil or back in the US? thanks in advance.

go to the site that lists the requirements and if it says FBI check then that is what you need. also if you have a record showing it was expunged then bring that in case you need it.

Are you sure that you need to present US records at all? Were you a US resident at the time? If not, and you're a Danish citizen emigrating from Denmark, your Danish background check may be enough.

Hi, some sites(depending on the embassy) say local others say federal. Thats why I was wondering if it was better to do it with PF in Brazil. Also federal records typically cannot be expunged. thanks.

US and Danish Citizen, lived most of my life in the US including the last 20 years. Thanks for the idea though.

Use only your Danish citizenship if they don´t ask your other citizenship. Then it will only
be records from Denmark or Brazil if you have stayed long enough.

Even if you state a US citizenship and if you´re required to do so, there´s no criminal verdict as a felon. The case was dropped so there should be no worry about that.

If you're currently in the US, or plan to be to request your background check, I strongly recommend using one of the FBI's "Approved Channelers", rather than going through the FBI itself. The document they give you is identical in every respect to what the FBI eventually sends, but they turn it around in days, not months, and they fingerprint you on the spot. It's pricey, but worth it, and will let you see immediately if your situation is even listed, so that you can obtain further documentation if you need it.

We ended up taking that route, even though I had put a request in to the FBI. At the time (June 2017) the FBI wait time was 8 to 10 weeks. My permanent residency had already been approved (using the document provided by the Channeler) when the identical document from the FBI finally arrived.
