Sister-In-Laws death in Brazil

    My sister-in-law died in Brazil, she was an Argentinian citizen who lived with a Brazilian man for 12 years. The circumstances are extremely weird concerning her death. The man had been kicked out of her property for 8 months and was coming to visit her the day of death. The question is are the Brazilian police obligated to assist family in investigating her death? Is there any way to become guardian of her children as the father was abusing them by beating which is why she told him to leave?

If the crime took place under the Brazilian Jurisdiction, yes, they are supposed to investigate the crime.

You have to contact the local Police Precint (Delegacia ), and also the Delegacia dA Mulher ( Women's Police Department ), if then available. 

Usuallly, the Delegacia da Mulher is under City Jurisdiction, so google it under your brower and the local address will pop up.

Good afternoon.  My condolences to you and your family for your loss.  The Brazilian authorities, like those of most other countries, are required to investigate suspicious deaths.  There are differences in police staffing, training, and professionalism from state to state, so it's impossible to tell you what to expect.  You may be able to obtain information on the investigation from the local police, but I wouldn't expect much cooperation to "assist family in investigating her death".  The police are insistent on conducting their own investigations.  Some states have special offices, often called "Delegacia da Mulher" or similar names, charged with investigation of crimes against women, including domestic violence.  If the state where she died has such an agency, contacting them may be helpful to you, at least for information.  Since your sister-in-law was an Argentine citizen, you should also contact the nearest Argentine consular representation to make them aware of the situation and to request their involvement.

For foreigners, taking Brazilian children away from a Brazilian father will be a very difficult undertaking, unless your sister-in-law's partner is actually charged.  Cooperation from the Delegacia da Mulher/General Police and representatives of Argentina may be able to make a difference, particularly if the children are also Argentine citizens.

@abthree we hired an attorney to help us, He is friends with many of the local government officials there. He found out that my sister-in-law had been to the police 3 times asking for help with her ex-partner. He had been psychologically bullying her, telling her he was going to come back and she would leave with nothing. Not even her girls. He had hit both my sister-in-law and one of his older daughters. He actually filmed himself smacking his own daughter and knocking her down. This was given to the police as evidence.

The guy is threatening to denounce my wife because the day it happened, the daughter called my wife on her mother's phone who was dead, my wife told her to call the police and said tell them you think the father did it. She thought so because of all the messages they were getting from their sisters saying she was scared, One of the last messages said either him or her was going to end up dead.

He can say whatever he wants, but telling your niece to call the police is not a crime, and you're safe in the US anyway.  Good idea to have an attorney there.  He should be able to handle any accusations from the partner in short order.
