Hi. Does anyone know if a British will drawn up by a solicitor in England is valid in Romania. We are not married so this is important. Thanks

If you are a British national and want that English law should govern your succession, your will should include a statement specifying this, otherwise the local romanian law will apply.

In Romania and other civil-law countries, your children or their descendants and the legal spouse, or your parents (if previous categories don't exist) are forced heirs and will inherit a reserved portion of your estate (half of what they may inherit in absence of a will) regardless of what you write in your will.

It is possible to stipulate in a will that a certain asset (a house for example) should be inherited by a certain person, provided its value as a percent from the entire estate value will not diminish the reserved portion inherited by the forced heirs.

Thank you. We'll sort this out as soon as he gets out of hospital - he currently has TB & pneumonia but is being excellently treated in the TB hospital in Campulung but hopefully on the road to recovery. As a note to other foreigners in Romania, it's better to sort things like this out before you are in our situation. Hindsight is always good!! Thanks again. Sue
