Expat Work Remotely from Netherlands (NL) for a Ireland (IR) job

Siddharth Thawani

Hi,
We are an Indian couple (Expats) shifting to Europe. My company is based out of Amsterdam, Netherlands & my work Visa will be sponsored for NL. My wife's company (Microsoft) vacancy is based out of Dublin, Ireland, so her work Visa will be sponsored for Ireland.
Now, can we both live in Amsterdam & she can work remotely for her Dublin based employer? If she gets a Spouse dependant visa in Netherlands, will that allow her to work remotely for a Dublin team, while residing from Amsterdam?
Also, we are open for vice-versa if that works out smoother. We both can live in Dublin & I will work remotely for my employer based out of Amsterdam.
Please assist!

To be honest; this is a hugely complicated subject and if you're using the intra-corporate or skilled migrant scheme; your companies will be hiring legal entities who do this stuff for a living; I strongly recommend you go and ask there because if someone screws up here you want somewhere you can go and fall back on

Some points for you to ponder:

Neither of you are EU citizens, so none of you has the right to live and work anywhere in the EU, you will be limited by your work visa.  You cannot be resident in more than one country at a time.  There's nothing stopping you from being a tourist within the EU, your residence permit will allow that.

Your employer will give you a work contract that is valid in the country where they are based, it will be worthless in any other country.  Both countries will require people who work there to have a contract that can be enforced in that countries courts.

There are differences in each countries employment laws (holidays, sick pay, workplace safety et al); a Dutch court cannot adjudicate if you fall down the stairs of your house in Dublin while working there and vice-versa.

Health Insurance - is mandatory in the Netherlands while there is a kind of state system in Ireland; who insures who where?  How do you arrange cover that will work when you need it to.

You will be deemed as being resident in the country where you live for the majority of the tax year.  There are tax treaties in place between many countries (you need to check) that prevent double taxation and declare who taxes were on pensions, but they only apply to income tax, not social taxes; if anyone tells you that's not a problem, they are at best misinformed.  So, where you are deemed as being resident means that country will assess "you" for all taxes on your worldwide income that are not expressly covered by a tax treaty; so if you have investments, savings that generate an income elsewhere in the world, you will be assessed for taxes where you are resident.

I know this hasn't helped and there are probably things I haven't thought of, but please accept this is a complicated subject and that sometimes internet forums are not the best places to go and ask.
