Tenant rights and notice period in Hungary

Hello my dear friends,

Recently I had to move out of a very noisy flat because I couldnt sleep there, the house has extremely poor sound insulation.

The landlord asked I pay for one month of rent in November plus retaining of 2month rent worth of deposit.

Is this common in Hungary?

She also threatened that if I dont accept the offer I would need to pay the rent for another 3months till January, as the contract stated there is a 90 day notice period.

But 10days ago, she texted me saying if I move out I would not have to pay the rent of November, only losing my deposit. Could her text message count as legal evidence?

To be honest I did not consult a lawyer before signing the contract, I also didnt expect such a serious issue would occur, now it all seems very unfair and pure bullying.

I wonder if anyone has any similar experiences with such dispute, should I bother consulting a lawyer as it is quite expensive or should I accept my bad luck?

Thank you all in advance!

OK, I am no lawyer so no expert.

When she texted you saying, "if you move out you would not have to pay the rent of November, only losing your deposit," she made a legally relevant declaration.

By offering this, she effectively waived her right to the 90-day notice period and the November rent in exchange for the immediate termination of the lease and the retention of the deposit.

You accepted this by moving out. She cannot retroactively undo this agreement just because she changed her mind or wants more money.

You could call her bluff. I don't know?

See what others have to say, this forum is pretty active, so won't take long for others to reply.

This is the wild west, they make their own rules.

Since you already moved out it looks like that,s it and do not count on getting any deposit money back.

I guess it was a lucky thing to not pay for 3 months, just the 2.

Sorry, I know the walls are not exactly sound proof.

I sleep with ear plugs and turn on my music if people want to party, I will join them.

I dislike both the neighobrs on each side of us.

A couple moved in with IDK, 2 or 3 brats.Father seems to be a drunk, judging by his screaming. Kids cry none stop or scream and run; Quiet for hours then it starts again. Was wondering if I may contact child services one day. Not my style but if they beat those kids I many .

2 neighbors contacted the useless manager already. My husband refused to sign the paper to toss them out, Gypsy family and since we are elderly we want no trouble from idiots.

Losers who I know will not be covering the rent too much longer judging by they way they look and act.

They are serious here with legal papers such as leases but collecting is anotheer thing; Since you paid up front, it is not coming back.

Good luck on your new flat, peace is worth more then money.

You are lucky you rented, we bought.

I don't know about here - we own our house - but in my home country (UK), there's legal protection frameworks for deposits.    Maybe there is something here which is equivalent here.  If it was EU law, there will be something.

I am no lawyer but it might be useful to ask ChatGPT or another AI about it.  I have found it to quite invaluable in framing points for international legal disputes and negotiations.  One still has to do one's own research and check answers carefully.

Law here in Hungary is "Roman Law" whereas in my country (and many other English speaking countries), it is "Common Law".   That's a really significant so the answers from AI have to be taken in context.  Generally it means that HU law (like most of Europe) is based literally on what it says in the Civil Code, not on any interpretations which historically have become applied (i.e. Common Law).

AI can read Hungarian and translate answers into many languages.  Its worth trying.  You can also upload the contract to AI, it will read it and comment. It doesn't matter what language it is in.

BTW, AI is revolutionising legal process.  Suddenly everyone's got a useful lawyer cum legal back up behind them - albeit one that hallucinates so caution applies.  I am using it in a current dispute with our water company - it's been very informative.

Do you have something like citizen advice in Hungary? We do have something similar in Austria,

No idea.  There must be.

There's a severe problem here with things like ombudsman and some utilities.  They are often judge and jury in disputes.  There are regulators but their activities are really rather weak as far as I can see - deliberately weak because of previous political interference.

We get form/template letters from the water company threatening us with all sorts of penalties and threats.  It's real abuse and seems like extortion.  There's almost no-one to complain to and no-one seems to take responsibility. Quite literally, they deny it's up to them.

It seems we might have to hire a lawyer because of their threats - procedurally the local government screwed up.  Even they say it's not their fault.  But legally they are and were required to maintain proper records.  It seems they did not do that.  Moreover they are over charging - something still not resolved.

Our current tactic is to increase their costs of administration so it makes no sense for them to pursue us.  If we did hire a lawyer, we'll be asking for our costs to be refunded by them via the courts.

Get a lawyer. Urgently. " Szerezzen ügyvédet. Sürgősen".

Actually I contacted a few lawyers, but i have no experience in legal matters. Idk how to choose a good one, I can only read from google reviews

@SimCityAT

That's when I think this is going out of hand, because she told me I dont have to pay the rent of November, that's why I moved out. Otherwise, people with any logic would stay an extra month instead of paying rent for 2 flats. She claimed that it is also my responsibility to read the contract carefully

@Marilyn Tassy

Yes I doubt I could get the 2month rent worth of deposit back.

But now she asked for rent of November even though before she texted me I dont have to pay for November if I move out by Oct 31st.

The problem with that flat is I could hear all 5 neighbors'(there is no one downstairs) all activities, walking, kids running, washing machines, vacuums, it feels nothing like a private flat. It was impossible to sleep continuous several hours
