Tracey&Gus

Hi I make and sell polymer clay items from home currently in Australia which gives me a bit of extra pocket money. Is this type of business allowed in Thailand, using such platforms as Etsy and Facebook to advertise.

Any business in thailand mut be registered and tax returns made and visas must be appropriate to that employment and thais are very strict about that. They also wont consider it as a hobby if money is changing hands.  I knoe retirees who run a bar as a hobby and everything must be registered.  However, if you tell no one authorities will never know, i lived there for 2 years selling shirts and bags without any issues.  Just stay brlow the radar you will be fine.

IMHO: If you are make 10 things a month that sell for 'pocket money' - say under 3,000 baht - you can do that and take the risk of being caught, which, for that amount, is likely almost zero. Tea money would probably make any problems vanish. However if you are making a business of it then you need to register the business, have a Thai partner (can be silent, a friend, lover, spouse - this is where every foreign is rolling the dice as if you get tossed out of the country or fall out of a balcony someone is better off) who owns 51% of the business, and employ some Thais to work it. I'm not certain the number but I think if you are employing 4 or more Thais you can get a business visa - so that's something to consider however that can't be done for pocket money. Also consider that if you are caught without a registered business you might go straight into custody and put on a plane out of the country without being allow to settle your affairs. That can be a real hassle. The upside is you wouldn't be looking at any jail time. Worst case you are banned from re-entry for 5 years (or whatever) and end up losing most of your possessions that you have in Thailand. NOTE: It is a very good idea to make a few friends who you could send your keys and they would go pack up your stuff, send it to you, and deal with selling whatever on your behalf. That or be ready to walk away from everything. That's extremely unlikely to happen but it is a risk you need to be able to sleep knowing.
