DP 10 Renewal ESD Rejected

Hi,

I am desparately trying to apply to renew my bussiness partners EP.

reason for rejection: Possition not required.

I am appealing to get him back as he holds 49% of shares in the company and has all the technical know how related to what we do.

Please advice me how i could get appeal, what documents I require to submit to get approval at soonest as he is the Chq Signing person and the company cannot perform without him.

Also since we hv applied special pass once (while awaiting the ESD process),he has been told tht he should stay in his country of origin,where he is now(pakistan) for at least 3 month. Please do advice me how i could get him to return to malaysia while i try to get approval for his DP10 in the soonest time please?

The usual reason for this situation is that the skills should have been passed on during the timeframe of the EP. So that will be one of the grounds you will need to cover and explain why this did not or could not take place.

Thanking you for your reply. Kindly be specific, how do i cover the grounds during EP?

Or are you saying I should elaborate further in his technical expertise in my appeal?

Should I show tht salary has been banked into his account?

Should i also include a comprehensive CV in my appeal?

You need to respond unemotionally, factually, and concisely.

You would need to explain what exactly his expertise entails, to show that he is required in the daily running of the company and not just as an investor. I am suggesting you write a detailed description of his role.

Other companies with a similar set up to yours have also had this issue. The appeal needs to be very specific about your business partner's skills and experience before forming the company. This is NOT a CV, but a narrative that shows how his skills relate to the continuation of your company.

Bearing in mind the next response will be that skills transfer should take place or a Malaysian with similar skills should be doing the job, you should cover why this has not taken place and why your BP needs to continue to work in Malaysia.
