Life partner permit or visa for South Africa

My life partner and me (SA citizen) have been living together for more than 5 years in Europe. I want to relocate back to South Africa together with my partner.

There is confusing information about applying for a life partner visa / permit. Perhaps someone could help with following questions:

  • Can a life partner apply for a life partner visa/permit directly in South Africa on a 90 day holiday visa?
  • If not and the foreign life partner has to go back to his/her home country and apply at an embassy how can both partners sign the form DHA-1712A together when only one travels back to Europe? Is it also possible to sign that form in South Africa with a commissioner of oaths (Police station)?
  • Is it possible to directly apply for permanent residence (life partner) when the relationship is older than 5 years? Where are applications made in SA: Home affairs office or VFS?


Hope somebody can help us here.

Hi there,


thank you for your reply. I think the rule that a foreign spouse has to apply for a life partner permit in a SA embassy overseas was overturned in 2018 by the Constitutional court (case CCT 114/18). So it should be possible to apply for a temporary or permanent permit on a visitor’s visa. Can anyone give some more advice on this?
