I am Nina from Cebu Philippines, my fiancee is from norway and we are planning to visit norway march next year , the thing is we planned to do the fiancee visa however as i check on the vfs home page checklist req. It was stated their that if my fiancee is married before the req needed is the divorced cert from the country where the marriage is taken place.. My fiancee was divorce for almost 6 years now , he married with his x wife here in the philippines and the divorce is in norway. Could someone here advice us what to do ,does he need to contact the NSO in regards with his divorce for their divorce be legal here in the philippines. Or any advice pls so that the time i set the appointment we would have all the requirements needed. Thank you so much and best regards Nina

Hello Nina,
Well in his case, its not as simple as contacting the NSO, It is not a simple matter of presenting a copy of your foreign divorce decree to a Philippine government office.
Recognition is a judicial process where both the foreign divorce and the foreign divorce law need to be proven in Court. You will need to file a Petition for Recognition of Foreign Divorce with the Regional Trial Court in the Philippines. You will need to get a lawyer to prepare and conduct the case.
The foreign documents, on the other hand, will need to be certified by the correct foreign office and they will need to be authenticated (Red Ribboned) by the Department of Foreign Affairs or the Philippine embassy in the foreign country. If a foreign document is not in English, then its certified English translation is also needed and this also has to Getting your documents ready is an important first step. be authenticated by the DFA.
Its a tedious process, i just hope you have enough time to do this till March comes.
Best regards,
Joanne

Thanks joanne for the immediate response., if thats the case would it be possible if made another option, like getting the tourist visa instead of the fiancee visa and had our marriage there then after when i get back here in cebu ,we will proceed with the family reunification .. Would that be possible. ? Best regards Nina..

Hi Nina,
You can get tourist visa, and get married in Norway, i have friends who has done that, np. But,  here’s the thing, you cannot register your Norwegian marriage in Philippines till you get the divorce recognized in Philippines. You will also have to come back to Philippines after tourist visa expires and apply for family reunification. Although you can apply as skilled worker to extend your stay.

Mvh, Joanne
