Changing employer - HSM Visa

shivangimohan94

Hi,
I am an Indian, working in Spain, I got a new job & I decided moving to Netherlands on HSM work visa. I have a situation:
Company A provided me offer & arranged for HSM Visa, I am scheduled to join office next month.
Now my current company is ready to transfer me to Netherlands from Spain, & also arranging for HSM visa.
I want to know what is the procedure? What backlashes can I get in the process? Is there a chance that my visa will be rejected or worse I will be black listed?

Any insights will help me take better decision.

NOTE: Offer from my current company is very good,
I am currently living in Spain & will move from here to Netherlands
Both the companies are listed in IND

Hi and welcome to the Forum.

As you've described it, providing your employer meets all the requirements to take you on as an HSM, then I don't envisage any problems.

The procedure is simple, your employer applies to the Dutch Government (IND) for your HSM visa, no later than 90 days later you should get your visa.  Once you have your visa, you can work in the Netherlands; don't forget you have to register with the local council where you live within 5 days of arriving.

Hope this helps.

Okay! Thank you so much! :) I have additional question.
Is 30% ruling provided if I get the ICT visa?

Hi again.

Then you need to be careful.  The 30% tax ruling is actually awarded to your employer, not you, they then pass on as little (or as much) as they wish.  One of the requirements to qualify for 30% is that you must have been recruited from outside the Netherlands, if you switch employers I don't know what happens because factually, you will no longer meet that basic requirement.  My advice is to ask your new employer to speak to the Belastingdienst and see if you can do it.

Hope this helps.
