Moving my wife to the UK

Yes we are married. My wife is from Mauritius. The document I have is a recognised marriage certificate with the apostle.

I went to see a lawyer but they were unhelpful. Iv read everything I can find about UK immigration but I'm totally stumped at this point with how to proceed.

To start with in addition to your income your wife has to do an English test recognised by the UK.  You have to prove that you earn the required income if it's only the wife or additional income for any child.  Go on the website www.gov.uk/join-family-in-uk

This subject has been discussed in a lot of detail many times on this forum, I suggest you go through the previous threads which sounds relevant and only raise questions where you are in doubt.

The regulations relating to bringing a spouse from a non EU country have been changing very rapidly , therefore I will doubt that any member will have an up to date knowledge,  there is no harm in asking other members but i feel a member's knowledge will be limited to his own experience only. At the end of the day, you will need to hire services of a good professional immigration lawyer.

Iv already figured all that out. It's the other stuff that drives me crazy. I earn £22k, I have done for four weeks. Before this I earned £17k for 12 months. I only left because I had to. I had 9 months abroad and out of work. It's the whole being in work for 23 weeks and to have a baby it takes 26 weeks to get paternity leave, so I'm 3 weeks shy of that. I can't use my old pay slips because of the gap I had and I will only be here in the UK for 4 months because I need to be at the birth. Basically I don't know why I have to come back and start again collecting six months worth of pay slips.

This crazy messing about waiting and being a absent father and husband is a concern. It's the whole fact that the lawyer seamed to think that on entry I'll still be subject to a interview and that we may be rejected. Furthermore the guy actually thought id give him private conversations over Skype as support. I'm not allowed to do this and I don't want to.

What I'm saying is that I meet all the requirements and so does my wife (fluent English), plus were only young so we're not a bought wife case were just a new family. So we just need to apply now. The part I'm lost with is how to do it. I'm scared of being rejected despite meeting everything and I don't understand why I'm working and earning lots and not seeing any benefit. I need advice and help but I don't know how to. Iv tried one lawyer, they quoted £500 plus £1100 application fees. Now my polish work mates don't have this kinda messing about and I don't see why I can't just buy baby clothes for when we get home.

My issue is that when I meet requirements the government have something new. They lie to me and give false information.

I want information that works, not .gov.uk info as it's misleading, not boarder info as they have lied to me and not embassy info because they don't advise me when I ask.

I'm at the point of saying fuck it, let's go to the EU because my polish EU friends have more rights here so maybe I'll have more rights abroad. I really really don't know how to move forward anymore. I don't have faith in the application and I don't trust the government to be honest and reliable.

If you listen to too many advisors then you will be lost.  The fact that your wife speak English does not exempt her from the English test.  English is my first language yet I had to do an English test to prove I can speak the language.  A certificate is required.  Not from just any college but from the list given by the home office.  A p60 may be required to show your annual income.  If you have money saved in the bank that may also help. I have used information from direct gov and it has always been correct.  Whatever updates that come they are put on the website.

I haven't got this list of certificates that are valid, iv been concentrating on the payslips. Iv made the quota but I have to wait 6 months to qualify. However, I'm hoping to get the English test set up as a online thing in my wife's country because if we have to fly to the EU for it, it would mean that I would have to be absent for at least a year to save up the cash to fly to where these tests are. Hence why I say she is a natural at English because the test will be easy for her. It's just accessing it

For your information.  If your wife is still in Mauritius she can do the test at the British Council . Rose hill busy section. Beau Bassin Rose hill. No need to fly to far for the English test.  She can even to the lower entry KET.
