Cancellation of IPA for SPass

yinmaylwin07

Hello there!!

I am seeking advice on my issues of S Pass application.
I am currently employed by Company A and got the offer from Company B. After company B have already applied the pass and i get the offer from my dream company Company C. But the company B is holding the IPA and didn’t cancel for me on purposely despite I have messaged them and text them numerous times. Meanwhile the Company C couldn’t apply new application for me.

Is there any ways to get rid of company B IPA ??
As I have called and asked about the MOM and they said let the company B to call them regarding of this matter.
The problem is People from company B didn’t give me a single reply or responses.😣

Thanks in advance :)

Did you properly terminate the employment contract you have with B?
(Check the contract, which is valid once the work pass is approved and thus you are obliged to fulfil it, for the termination method and notice period required!)
If so, and the company does not cancel the work pass when the termination becomes effective, you can contact MoM with written proof (contract, termination letter, communication with employer, etc.) and they will cancel the work pass for you.
Company C can only apply for a work pass after this is completed.

Hi Beppi

Thank your for the suggestion. :)

I have inform the boss and the HR from Company B with written form and they both acknowledged that already. Since there is no contract or form I have signed with Company B as the offer is given by verbally in face 2 face meeting.

In that case can I write to MOM to withdraw my IPA with them?? Will that effect to my next application with Company C?? Even tho company C said will reappear for me in case of rejection!!

If can write to MOM about this issue, do I still need to wait till 14 days to fulfil the rule of notice period within probation even I didn’t start working with Company B??

Offers are not made verbally, an employment contract is essential and part of your application process, least the details on it.

If the agreement (even if verbal) with company B required 14 days notice, you have to give them that time.
I still suggest you contact B and find a mutually agreeable solution. If they don't write, call them!

Hi Beppi,

Noted on that!!
I call HR from company B and still didn’t get the answer.
So I write to MOM and MOM request me to sent over the proof of refusing to withdraw or cancel the pass.
Luckily I have written proof for offer declining. However, the important parts of refusing to cancel the IPA was talking while I was on phone conversation  with them! So I left only call history and duration.

Will that be good enough to provide MOM??

You can of course try -in the end MoM will decide what to do.
