Absolutely correct. To add, if ones spouse is out of country, the court will accept a psychologists evaluation based on a email Q&A through the attorney.

You can try the "presumed dead" petition with a lawyer.

If the foreigner is not there anymore for more than 4 years, after two hearing in the Court of Justice (one with witness, one with future ex-wife), and a publication for 15 days in a local and national newspaper, the Judge can declared the husband "presumed dead", way much easier now for all these filipinas that went a little faster on the wedding miracle.

Cost depends on the lawyer. Manila is expensive. Rest of the country less.
