I-864 Shows Insufficient Income

moonunit0103

Hi,

I have been waiting for Visa interviews to resume.  My wife got approved by NBC, then I submitted paperwork, along with tax forms, 1099s, bank statements, and brokerage statements from my IRA.

Despite my Social Security benefits totalling $31,458.00 for 2019, and my bank and brokerage totalling almost $900,000.00, I seem to lack funds to fully sponsor my wife.  Also, my house is fully paid for, as are my cars.  My last FICO score was 829.  I am also getting a private disability payment monthly of over $8,000.00 for another 3 years, when I turn 65, which is tax-free.  Looking at my 1040, it doesnt look like I have much to spare.

I am not quite sure what else to do.  I want the Visa interview to go smoothly when things resume.

Is this something that can be done ahead of the time to remedy this?

With that much assets, you can sponsor her whole clan. What kind of math is the immigration using?

Maybe the person just took a quick look at my 1040 and made a snap judgment.

Very likely, since little or none of the social security is taxable, the adjusted gross income would be very small, but the SSA income alone should be sufficient.

I looked at Form 1-864, the last page, page number 17 is interesting. Did you get a rejection or waiting for an answer?

What I think immigration is looking at your wifes financial status, not yours.

I might suggest that if you have bank accounts in the US put your wifes name on the account, then you can download a statement showing your wife has assets in the US.

Secondly amend your last tax return and file jointly, your wife does not need a SS number as long as you do not list your wife as a dependent. My refund checks are made out jointly to my wife and myself.

If you can add your wife to your IRA to make it jointly, I don't know if you can but if you can I would do it.

The way I understand it, immigration wants to know if your wife has assets  sufficient enough for her to wanting to return to the Philippines other than  looking for a free meal on the US Taxpayers.

Maybe your wife could get a tourist visa good for 3 or 6 months, then you get married in the US.
