I find your request rather unusual. This is because it is not your responsibility to make the Appeal. Your potential employer is who should take this action. Only they know the circumstances and the importance of your recruitment to their business.  It is their "fire" and true ability to hire you that is all important.

Do you know why the DP10 was rejected?  There are all kinds of reasons, including that the company does not have the correct structure or paid-up capital, or even a quota remaining to recruit you. Or they simply have not followed the correct procedure (for example the position cannot be offered to a foreigner because locally recruited staff are available and applied for the position).

It would be good to consider these reasons. The lawyer cannot get involved with immigration as an intermediary. Immigration will only deal online with the company.

So based on the reason for rejection is what needs (or can) be done.

Thanks for assistance, the company asked me to find a lawyer to assist in this matters, since this a firs time that they are applying to hire a foreigner.
They found the reasons with immigration  which are :

1-No requirement for an expertise for the position applied
2-In sufficient working experience ( However, I have 8 years experiences, )

We need some one who can write proper appeal and well explanations

Gravitas

1-No requirement for an expertise for the position applied
The company has to prove they have advertised the position and there are no qualified Malaysians who have applied who have the appropriate qualifications and experience.

2-In sufficient working experience ( However, I have 8 years experiences, )
Is the experience directly related to the Job Specification?  If you have just been at work for 8 years doing other work, then it does not count.

1.The company has to prove they have advertised the position and there are no qualified Malaysians who have applied who have the appropriate qualifications and experience.

They advertised at the board of universities since they were looking for foreigner who can assist them in their businesses at middle east countries .is it acceptable?

2. Is the experience directly related to the Job Specification?  If you have just been at work for 8 years doing other work, then it does not count.
The company offered me communication liaison position, I was working as marketing and communication manager for 8 years(2001-2008) in three different companies in my home country before i came over Malaysia ,from 2009-2017 I did my further study in Malaysia . Is it countable ?

Can they appeal it?which i kind of documents they should prepare it?

Shehajaz

Ofcourse you can appeal

Has it been rejected or only returned?

Gravitas

Right lets take another look at the rejection.

1. I just re-read the reason for the rejection - it seems to say the position does not require a person with your experience i.e. you are overqualified. This may have something to do with the salary level being offered as being too low.

Basically it seems as if the employer needs to advertise in the local market as well, say on Job Street. Companies cannot just try to recruit foreigners as the local applicant pool has to be protected. Now IF the job requires foreign languages, then this might be a way to justify only advertising to foreigners.

2. It also may indicate that your experience does not match the job description.

To appeal the company needs to speak to ESD and clarify the issues and the address them. Perhaps some of the issues above can be useful.

shadiraj

Unfortunately, they rejected

Shehajaz

No problem you can always appeal with the right justification
