Foreign Land Ownership

• Foreigners cannot own land outright in Benin. Since the Land Code of January 14, 2013 (Law 2013-01) came into force, only Beninese nationals may hold title to land; foreign individuals or entities can only acquire long-term leases (up to ~50 years, non-extendable, and limited acreage per investor) ([link moderated]).

• However, foreigners may own buildings (real estate structures) located on urban land,

subject to official permits and the “Acte de Propriété” certificate; direct ownership of plots remains restricted (Generis Global Legal Services).

So there is no point for  Foreigners to invest in a Country where after 50 years the land/building will be taking away from the  Foreigners investors

Investment is about returns over time, not about owning land forever.

Most serious foreign investors—hotels, factories, agribusiness, logistics—model returns over 10–30 years, not 100+. A 50-year lease is longer than many human careers. It is long enough to amortize construction and equipment several times over. Also, it is comparable to or longer than concessions in many countries.

After 50 years, the investor has already recovered capital, earned profit, often renegotiated, exited, or sold the business.

Benin is not anti-foreign; it follows a model used worldwide to protect national land sovereignty. (examples of countries where foreigners cannot own land include: Vietnam, Thailand, China, or Ethiopia [which we also cover] Yet billions of dollars of FDI still flow into these countries every year.

Finally, after 50 years, you can probably qualify for citizenship anyway...😄
