Achat immobilier à l'Ile Maurice

Bonjour,

est-ce qu'un étranger peut acheter une maison ou un appartement à l'Ile Maurice ?

Si c'est le cas, est-ce compliqué ? Quelles sont les formalités pour devenir propriétaire à l'Ile Maurice ?

Pour résumer : IRS = accession à la propriété foncière par un étranger

RES = investissement pour les mauriciens

Les deux sont d'un prix élevé pas toujours justifié.

L'accession immobilière simple est refusée à toute personne privée non mauricienne.

Acquisition of Residential Property
To acquire residential property, there are three avenues:

1. Buying a property in an approved IRS project - Minimum investment required is USD 500,000 and the purchaser through the IRS Company has to register with the BOI.

2. Buying a property in a RES project - Minimum investment of USD 100,000 and the purchaser through the RES Company has to register with the BOI. This is the cheapest route of acquiring a property in Mauritius but the purchaser isn't guaranteed that he will be granted a Residence permit !!!!!!!.
The purchaser must then apply for a residency permit  in any of the four categories that is available. These are as an Investor, Self-Employed, a Professional and a Retired Non-Citizen. Vicious circle in a way.

3. Buying a property with Permanent Residence Permit ( personal authorization from the PM office and it is NOT easy)- You can purchase property anywhere on the island. Before finalizing the sale agreement a Certificate of Approval must be obtained from the BOI

Note: A Lease Agreement - Previously these procedures could have been circumvented by entering into a lease agreement for a period less than 20 years. This didn't require any certificate of approval. The rationale for this was that a non-citizen could secure a property through a long lease and which in most cases had the election by the lessee to convert the lease agreement to a purchase agreement ( disguised purchase agreement) . During the lease period the purchaser had ample time to apply for Permanent Residency (unfortunately the 10 yr residency permit is still not a fait accompli). However, this loophole has been closed during the 2008 Budget and in the subsequent amendment to The Non-Citizens (Property Restriction) Act was amended, in section 3(3) - by making a tenancy agreement for a term not exceeding 4 years.  (was in practice in 1990's but NOT RECOMMENDED)

bonjour, moi je pense que c'est très risqué, d'une part on n'est pas sur d'avoir le permis de resident au delà des 10 ans quand on a passé ttes les embuches pour y arriver et d'autre part, quid de la succession, si jamais on vient à deceder?
Je pense que les etrangers sont plus safe en louant un bien, pas besoin de passer à travers ttes ces affres du bon vouloir ou des caprices d'un gouvernement qui viendrait à changer, de nouvelles conjonctures qui viendraient defaire tt ce qui a été mis en place du jour au lendemain... c'et trop aleatoire. Voilà mon sentiment , après il y en a qui aime jouer à la roulette russe...
