How to calculate the 14 days out in Malaysia for tax return

Dear All,

I  started working in Malaysia KL from April 14, 2019.

I went to India for personal trip on Aug 9 to Aug 19, 2019. I have confusion on calculating the 14 days out of Malaysia for resident tax calculation

I Also planned to go for another 5 days for a marriage function on Sep 14 to Sep 18, 2019.

My earlier flight details are,

My depart date was  9th August 10.30PM from KL
Return on 19th August 5.30AM  to KL

1.Should I include 9th & 19th on 14 days calculation ?  OR
2.Should I consider only depart date & not return date

please correct me if am wrong.

Here is my calculation
9th Sep - 1 Day (start from KL - 10.30PM )
10,11,12,13,14,15,16,17 ,18 - 13 Days
19th Aug - 1 Day (reach KL  10.30AM).

Let me know how much days I was out of Malaysia

Also Let me know if I am good to travel for the marriage function on Sep 14 and back by Sep 18,2019

Can u pls help me understand tax calculation & tax linking for my case as below,

1) I have started working in Malaysia from Aug15,2019, so i would not be able to complete 182 days hence from Aug'2019 to Dec2019 my tax deducted would be 28% right ?
2) Is it okay for me to take more than 14 days leave (example : 7 days in Oct 2019 + 10 days in December) = Total 17 days since by any ways I would not able to complete 182 days criteria and become tax resident for 2019 ?
3) From Jan'2020 until completion of 182 days around July 2020 would I still be taxed at 28% again ?
4) Also from Jan'2020 until 182 days completion around July2020 if I take less than 14 days, I would become a tax resident for 2020 right ?
5) Will I still be able to link tax years 2019 (with more than 14 days outside Malaysia in 2019) & year 2020 in which I have attained tax resident ?
5) After I have become tax resident in 2020 (stayed greatest than 182 days in 2020), can I take leaves more than 14 days or do I still need to keep mind of not exceeding 14 days even after becoming tax resident ?
5) Also, if years 2019 & 2020 can be linked then I would need to file return around Apr2021 or will need to claim my returns if I leave Malaysia permanently in 2020 let's say Nov'2020 right (In this case would my overpaid tax in 2019 be claimed back) ?

Actually you should be calculating the days you are IN Malaysia. A partial day is counted as being physically present.  SO since you are present in Malaysia a partial day on 9th September and 19th of August those days are not calculated as part of your travel abroad. So you have 13 total days which falls within your social visit allowance.

Assuming that you will also have partial days in Malaysia September 14  and September 18...only 3 days would be "outside Malaysia". But that would be two days in excess of your allowable limit.
