Resignation before the the contract ends

Hi i would like to know if there is posibilities i can resign on my current job, i been working here since 2018 until now almost 1year and 3 months but i want to transfer in other company, i have passed my resignation but my employer dont want to accept it. Is there any way to move to other employer here in saudi?

I have work here for 3 months, still on probationary period since it was stipulated in the contract that probationary period is 180 days. The contract states that the employer has the only right to terminate the contract however there is a clause that also states that an employee can resign giving 3 months notice. And if the employee resign he should shoulder cost of his return to his country.As it was not specified explicitly what does cost of return includes I would like to any of aside from final exit visa fee and flight ticket is there anything that my company could add from that?  Any advise on how to go about it? I can give more specific details if needed.

Usually, you will pay an equivalent of 1-2 months of basic salary as penalty for breach of contract aside from shouldering your flight back home. Unless you have a valid reason that could merit consideration from your employer, this is their means of getting back all the expenses they have spent to hire you. Fyi, a new worker needs at least 6 months to adjust to his new workplace, colleagues, and culture. Your determination and sacrifice will determine of how much you can go particularly in working overseas. I believed that you've been hired based on your qualifications (skills & personality wise) and merely by luck alone. Try to weigh things over and over again but ask assistance from any of government agencies of it is a matter of life and death.

Dear, I have same question,  I need to resign after completion of 10 years but my 11th-year contract is already renewed and 6 months are remaining.

Now my employer is claiming they will deduct the 6 months salary from my EOSB. do you think it's fair deduction although if you completed 10 years? Please advise

Hello po i just read ur post po regarding resignation before contract ends. Because i want to resign din po but stil i didn't finish any contract, this is my contract with them.  Can u help or give information about it and what would be the possible things to happen. Hello, AkPrince, I have a question po.

I came here last Sept 25,2019 under Ministry of Health. August 11, 2020 was my end of contract. Our HR automatically renewed our contract even without any sign. Now, I am on my second contract, the thing is I want to resign since I am not happy with the environment. If I resign, can they give me "exit paper" so that I can transfer to other hospital? That is what I only needed to be hired by other MOH hospital here in Aseer Region. Please enlighten me. Thank you!

You are allowed to resign in the middle of your contract as per labor laws, But you will have to serve a 60 day notice period OR pay them your 2 month salary.

Your employer might say that he will give you exit visa ONLY, In which case it is illegal, You must be confident and provide them with your resignation and mention that you got a better opportunity.
In this case it will be a written document and as per labor laws they cannot force you to stay more than the notice period, and if they issue you an EXIT visa only then you can go to labor office which will get you a stay on the exit .

They cannot do it and you have the full right to resign and claim your EOSB without an issue.

If they try to strong arm you than tell them you are going to Ministry of labor.

Keep in mind any contract obligations that you have signed and they do not comply with the rules set by MOL than that contract condition is Null and Void

I'm currently residing in Saudi in a Business visa also I'm having a valid work visa for Bahrain. One potential employer wants me to hire to his saudi company. He is ready to process a saudi work permit and iqama. With that being said,

1. Can saudi work visa be processed while holding a work visa for another country or

2. do I need to cancel all the current Visa in my name and travel back to my home country in order to process the saudi work visa.

3. In the current situation is saudi issuing new work permit or when it will resume issuing new work permits (note I'm currently inside KSA)

4. Is there any other risk that I need to consider

Your first step is to READ YOUR CONTRACT and determine what obligations you are owed and what rights you have.  This should be your starting point. Following this, you will then need to check the KSA Laws (https://prev.hrsd.gov.sa/sites/default/ … %20LAW.pdf) to then determine if this also imposes any further obligations and rights. Likely that the person you are dealing with in KSA does not understand this stuff themselves so once you have determined your positions, you will need to draft a clear and concise letter.

I worked for 8 yrs 3 months for this company. I've already submitted my resignation but the HR told me that my contract got renewed and I need to pay the balance of my contract. They are forcing me to either pay and leave or not leave till my contract ends after 7 months.


I didn't pay attention to my contract as I didnt resign at the time of renewal.


Can someone pls reply to me.

You can leave while you going on vacation but don't tell them you leaving. But you can do that only if you know you dont want to comeback to Saudi Arabia again
