Local/Resident willing to be tax representative?

Hi All,

I’m a UK Portuguese citizen who acquired my citizenship through my father who was born in a former colony.

I have only ever worked in the U.K. as a medical professional.

After Brexit in order to keep my citizenship the tax office are asking for me to have a tax representative as my U.K. address is no longer part of the EU.

I’m wondering if anyone who currently lives in Portugal would be willing to represent me for a small fee.

You would hardly have to do anything after registering given I’ve only ever been to Portugal for holiday, never worked there, don’t have any income whatsoever from Portugal.

I am on the health professional register so you could easily track me down should any problems arise (which there won’t be given I have no intention of working or having any income from Portugal) .

Please PM me if you can help or if you know of any way I can get a tax representative for a reasonable price.

Hi Rubetues,
I am sorry but I don't understand your problem. A person who has acquired portuguese nationality does not lose it just because UK is no longer part of the EU...

What do you need the fiscal representative in Portugal for? Is it to apply for NIF?

Being someone's fiscal representative gives powers, obligations and responsibilities to one person concerning other one in your own country or in any other country...

Hi Johnny

Unfortunately because U.K. has left the EU according to the Portuguese General Tax Law paragraph 6 of article 19 means that Portuguese citizens who do not reside in either Portugal or in the EU has to have a tax representative or face fines.

It appears in order to continue being a citizen, I have to have a NIF (which I do have), to maintain my NIF I need a tax representative... I cannot be a citizen without having an NIF.

Ok, you need a tax representative in Portugal because of Brexit and because you have a Portuguese NIF.

The question is why do you need a NIF if you do not live in Portugal and you do not have any activity in Portugal.

Having portuguese citizenship does not require you to have a NIF. Your father is not a portuguese citizen? You have citizenship by acquisition. In this list of documents to request citizenship, the NIF is not mentioned:

One thing is to have portuguese citizenship another one is to have a portuguese citizen card.

Even if you need this tax representative in Portugal, don't you have any family member in Portugal that could have this status? It would be the best option. Another is to contact a portuguese lawyer (who must be a member of the Portuguese Bar Association) and explain your situation.

Once you have a Portuguese tax number - it is for life. It has nothing to do with citizenship - different bureaucracy

Ah this makes sense then.

My NIF came with my citizen card.

Unfortunately no we don’t have any relatives or friends actually in Portugal since my father was from a colony.

I will go through a lawyer if needs must but ideally not as this will prove to be extremely expensive for the rest of my life - unless we retire to an EU country!

But I think you can request the NIF cancellation when the whole situation is regularized.

I have posted the law above - you need to have a secure email, only CTT offers this in Portugal. Then request the tax authority to do it for you as per the extract of the law above - once you have the secure email box

If you are liable for any taxes then other tax provisions may apply, and in that case you may need a fiscal representative eg these provisions do not cover income tax or vat   eg if you are renting a property either short or long term

Ok so just to clarify: if I register for a secure email through CTT I can ask the tax office to send correspondence to this secure email; this will negate the need for a tax representative?

Hello, this info is very helpful and I wonder if someone can help with a slightly different situation.

I am a British citizen resident in Portugal.

A few years ago I accepted to be tax representative for an acquaintance who wanted a NIF for opening a bank account.

Since then he never came back to Portugal, and I lost contact with him.

But I cannot figure out how to remove myself from being his tax representative. Is there a way? Can I just informs Financas that I no longer agree to be representative?

Hi all, I have exactly the same problem. When I lived and worked in Portugal I became fiscal rep for a friend who left in 2008 and has never been back. I have a holiday apartment still there and I can't appoint a fiscal rep until my friend's name is removed. There must be a way he can cancel his NIF or for me to remove him? Has anyone else had any success with this?

Have a look at article 19 of the LGT (Lei geral Tributaria) specifically 19-9 and 10 - you might have some joy - follow the procedures - do it by registered post with proof of posting. Law available on the AT web site

Thanks for advising but I've just checked messaged on the financial portal and they have advised that I can join via CTT but the appointment of a tax representative is still mandatory.   :(

I'm in the same boat as Carman and Rubetues, I received a letter from the tax office upon renewing my citizen card, no financial ties in Portugal and was going to go down the route on contacting the tax office about not having a fiscal representative.
@Carmen you saved me a job! Thank you!

I'm keen to know if anyone found a reasonable price Tax representative as I did a quick check online they not cheap especially this would be based on an annual service? 

Or others have found a way round on not having a Tax representative?

And does anyone know by not having a tax representative would delay citizen card renewal?

Would have to check with a lawyer, but that is not how I interpret the above extract of the law. Also article 19 14 of the Lei Geral tributária seems to point in the same way ie if  you have subscribed to notifications through the ctt, except in limited circumstances.a fiscal representative is not required. But it is not thec first time that the left hand does not know what the right hand is doing

It wouldn't, but the tax authority could issue a fine, but in my reading of the statutes, it would be difficult to stick. However, unless you are legally trained, might cost to fight this type of issue ie you might have to employ a lawyer to respond to a fine and, in the final analysis, if the tax authority sticks to its guns, the courts is the final arbiter

We have an accountant that does our finances for us every year all we do is submit our papers they do the rest & then we get a tax bill we pay tax bill job done.
This is our 3rd year of using our accountant & we have never had a problem with the tax office.
Also an accountant if far cheaper than a solicitor, not sure why you would use a solicitor.

Hi, I've only just found out this thread and I'm in the same position as you @Rubetues. The tax representative thing is all new to me as I've only found out through renewing my child's citizen card.

I'll be grateful if you could let me know if you guys ended up getting tax representative after obtaining the CTT email. Sorry it's probably all old news to you but I'm just stuck and don't know how I should progress. Like you said @rubetues, getting a tax representative that does nothing sounds like money that I couldn't saved, especially if this is on going and for a whole family. It's going to be costly just to maintain as a citizen!


Anyone else who could shed any light on this I'd be forever grateful!

This publication was literally just released in the past 3 weeks.

As far as I understand (bottom of page 2), it means you no longer need a representative if you sign up for the electronic notices.

I will add one layer of complexity in this discussion. My mother in law is in the exact same situation as all the above. She received this dreaded letter upon renewing her ID card. Only difference is that she received her card through the post this week!


The letter states that failing to assign a tax representative would delay the process to get an ID card but by the look of it, it was not to be. We are still stuck in this pickle to understand what to actually do about it.

The consulate in London is so unhelpful...

1 - What is an electronic notification?
The State Budget Act 2012 has given legal effectiveness to
notifications and quotations made electronically.
Electronic notification consists of a notification generated in digital format (PDF) and
electronic transmission of data to electronic mailbox and replaces the
sending the traditional correspondence by letter (on paper form).
The sending of notifications electronically is regulated in Article 19 of the General Law
(LGT).
2 - What modalities of electronic notifications are there?
The following are legally provided for, although not all of them are implemented,
electronic arrangement notifications:
Pursuant to Article 19(2) LGT and integrating the concept of domicile
fiscal:
i) ELECTRONIC NOTIFICATIONS AND CITATIONS ON THE FINANCE PORTAL - NCEPF
Law No. 71/2018 of December 31, which approved the State Budget for
2019 (LOE 2019), introduced in the CPPT, approved by Decree-Law No. 433/99,
26 October, Article 38a providing for the possibility of making notifications
and citations by electronic transmission of data in a reserved area on the Portal
finance, as an alternative means to other electronic mechanisms of
notification by introducing the legal regime for electronic notifications and citations
on the Finance Portal, which maintains the guarantee of their security
offered by other means of electronic notifications and citations.
In accordance with Article 38a(1) of the CPPT, Electronic Notifications and Citations
finance portal (NCEPF) target taxpayers:
(a) that they are required to have electronic voice mail in accordance with paragraph 12
article 19 of the LGT, have not communicated it to the tax administration in the
legal deadline for this purpose;
(b) residents in a State outside the European Union or the Economic Area
european union, who have not designated a representative resident in
national level;
(c) not being obliged to own and communicate the e-mail box,
opt for electronic notifications and citations on the Finance Portal;
(d) that although they have an electronic mailbox and have communicated it to the
tax administration, opt for electronic notifications and citations in the
Finance Portal;
(e) non-residents of, or residents who are absent to, member state of the European Union or the European Economic Area, the designation of which
representative is merely optional, who opt for notifications and
electronic citations on the Finance Portal.
The accession, withdrawal, unofficial registration and termination regimes, for
unofficially cancellation of Electronic Notifications and Citations on the Finance Portal
(NCEPF), are regulated by Ordinance No. 233/2019, of 25 July.
The Area Reserved for Electronic Notifications and Citations on the Finance Portal
(NCEPF) has special security measures in order to guarantee the
confidentiality, integrity and authenticity of notifications and citations, for
via the encryption of messages and other personal data, ensuring and
keeping records of acts performed in the system.
(ii) ELECTRONIC POSTAL BOX - ViaCTT
The Electronic Postal Box is a service that allows you to receive mail in
digital, with legal value, respecting the characteristics defined in paragraph 1 of art.
3 of the Electronic Commerce Law (Decree-Law No. 7/2004, of 7/1, amended by
Decree-Law No. 62/2009, of 3/10, and by Law No. 46/2012, of 8/29), guarantees the
integrity and confidentiality of your mail.
This service is under concession to CTT (ViaCTT Service).
ViaCTT is an Electronic Postal Box that works as a receptacle for
digital mail. CTT only places documents in the Electronic Postal Box
of entities previously authorized (subscribed) by citizens or companies.
iii) DIGITAL SINGLE ADDRESS
Provided for by Decree-Law no. 93/2017, of 1 August, and whose Public Service
of Electronic Notifications (SPNE) associated with the single digital address (MUD) if
is regulated by Ordinance No. 365/2017, of 27 December.
This type of notification is not yet available on the Portal of Finance

If you are a non-citizen, non-resident with a NIF but have no economic ties in Portugal except your spouse (citizen non-resident) has property (in their name only) that earns rental income, do you need to maintain a tax representative or file taxes??
