Hi I'm currently in Malta on Tourist Visa. Actually i appliend for long term vissa as my husband is working under work permit in Malta. As my husband is not compleate one year so i couldnot get Long term vissa. Is it to exetend my vissa from Malta???Plz do advice me

welcome to the forum.

I presume it was your husband who recently asked the same question. This is the answer i gave:

You cannot extend a Schengen (tourist) visa.

Please be aware that after one years stay in Malta you can apply for family reunification. But your wife won't be allowed to join you until you have been in Malta for two years although the director 'may' accept applications of TCN's who have been residing in Malta for less than two years.

Normally the family member (wife) should be residing outside Malta when the application is made although,here again, the director 'may' accept application if the family member is already in Malta.

Another provision is that you have reasonable prospects of obtaining the right to permanent residence.

You will need to be earning more than 16.675 € / year.

So you have to determine if your application would find preferable treatment by the director of DCEA.

The exact conditions are laid down in Legal Notice 150/2007.

There are so many if's and may's in your case that I would recommend taking a lawyer to support you and discuss your position with the DCEA department in Valletta.

You could also apply for her to stay with you without the rights out of the Family Reunification Program. Here again you have to discuss your case with the DCEA.

Your wife will also not get residency for longer than your own residency is valid.

And finally, make sure that her position is legally correct, ie don't even think of her overstaying her visa. Try and sort things out before.

So you should definitly go to the Department of Citizenship and Expatriate Affairs in Valletta and discuss your situation there with a Maltese friend or,even better, with an immigration lawyer.

on another issue!

On the forum we like to help and give advice but it should not be a one-way road! In the case of your husband we have given advice and commented but never heard back from him.

Without any more background information as to what he has organized to solve the problem and where he/you are stuck I can't give any more advice than I already have.

Dear, take my advice go by your self to the expatriate Dep. and talk to the manager try to explain your case, there's temporary residence for 6 months if you apply now better before your visa expired i;m not sure how long is your visa,,,, just you must have approval of your husband income must be over 16000 yearly ,and health insurance and good luck

Actually i got sangen vissa from Nepal so what i have to do to stay more time in Malta??? Do i have to go back in Nepal to apply for the vissa?? My husband is going to compleate one year on middle of Febuary 2013 and my vissa will expired on 16th of dec. So plz make me more clear what i can do to stay here in Malta.

Dear Designs Thank you very much for the help. well my vissa expire on 16 of december 2012. We both have health insureance and he is earning 20000 euro basicly per month so is that enough for yearly income?
Can you give me the address or the contact number of expatriate department??

Hi chinu,

you should do as I recommended in the answer post. Go to the Department of Citizenship and Expatriate Affairs at Castille House in Valletta ( near Upper Barrakka Gardens) and take a Maltese friend or your husbands boss or a lawyer with you to discuss your situation.

The Family Reunification Programm might be the wrong option to apply for as your husband doesn't really have a chance of getting Permanent Residency which is the basic requirement but those that don't qualify can still apply.

Your application for a visa has basically already been declined but there might be a chance if you go there in person although it will be your husband who has to apply for you.

Your husband has to have health insurance but do you have private health insurance - not travel health insurance? Travel health insurance does not cover you in Malta if you become a resident.

The income would be ok although I presume your talking about 2000 €/month and not 20000-))

yes it's the same address that Ricky says, and try to go these days as they are changing the residence from a sticker to an id card in the middle of November, and one thing....if you ask an employee there and she says they can't do any thing for you , don't listen to her !! try to ask every one and try to meet the director there are nice people over there  and they help a lot
